On 7/11/08 I received a Notice of Withholding letter along with a Hamilton County Municipal Court Affidavit & Order & Notice of Garnishment of Personal Earnings & Answer of Employer.

The letter features the Case Identifier, Court Ordered Amount, Court Ordered Percent, and Goal Amount.

The letter states that a Writ of Garnishment order has been received. Either a fixed dollar amount or a percentage will be deducted per pay period. The deduction will begin within one or two pay periods. Payments will be remitted to Hamilton County Municipal Crt. A copy of the order received has been attached for specific details and contact information for the issuing agency. To dispute this order or to obtain a release to stop the deduction, please contact the issuing agency. Once you obtain any additional documentation such as a modification or a release please forward it to your employer for processing. For any other questions, please call us at (866)324-5191.

This is from Lynn Demshock, V.P. of Garnishment Services, ADP Financial and Compliance Services, 7/3/08

They are going to take out 25% from my weekly income to pay off an amount of 1,527.86, which includes attorney's fees and court costs.

I don't even remember having a debt of this amount. But I've moved a couple times recently and so some of my paperwork has been lost.

They've seemingly already sent paperwork to my employer regarding the garnishment, which worries me, because I cannot afford to lose my job over this, which they state on one of the forms could very well happen.

They show the total probable amount now due which includes the unpaid portion of the judgment, at a 19% per annum payable until judgment is satisfied, along with the total court costs.

The judgment creditor/attorney is Deborah Kapala, P.O. Box 2036, Warren Mi 48090, Phone: 800-455-2554; x8685, 8755, 8515

I am currently homeless, and living in a homeless shelter, without any assets, and a seasonal job. With the income from this job, I'm trying to get housing, with assistance from HUD, and get back on my feet. Once I gain housing, I will need my income to pay the monthly rent, buy food, pay for my 2 storage units, and take care of other necessary items.

I cannot afford to have 25% of my weekly income from this job, taken out of my paycheck.

I'm totally green when it comes to this sort of thing, it's all Greek to me.

I don't know where to even start, and they say I only have 5 days from 7/11 to obtain a release.

Can anyone out there help me?
