Complaint Review: Asset Acceptance

Asset Acceptance threatening tone on telephone -- very abusive -- harrassing. Warren Michigan

I was called by a gentleman (actually, he was not a gentleman, but very rude) concerning an old bill of mine from Ameritech (phone company in Indiana)

When he first called, I asked if I could call him back, as his phone call had woke me up. He persisted to continue and discuss the bill, and wouldn't even let me speak. I finally hung up on him and went back to sleep.

A few hours later, he called back saying how it wasn't cool that I hung up on him. I told him that I'll pay the bill when I can afford it. He persisted to interrupt me and got very loud and aggressive, then yelled (yes, he yelled) at me "Pay the bill!!".

He then continued to try to out talk me whenever I tried to speak. He asked if I wanted to take care of the bill now, and when I opened my mouth, he kept interrupting me.

This person acted like he was taking this bill personally, which is very unprofessional, in my opinion. He had a very "thug" or "tough guy" attitude on the phone. The kind of attitude someone gets when they are angry enough to fight someone.

He said the bill was 3 years old, which is not possible. I used Ameritech while living in Indiana, but have been in Florida since 2001, and have not used Ameritech since leaving Indiana. Which, if the debt is legitimate, would make it 5 years old.

I used Ameritech, but I don't remember leaving an outstanding balance, though I could be wrong.

It seems that this man was trying to scare me into giving him my information. Like most people, I will not give my information to anyone over the telephone....especially my bank account information.

This company needs to be shut down. I have nothing against collection agencies who do their job in a professional and legal manner, but the tactics this person used are totally uncalled for.

Sincerely,
Kurt

An Easy Solution

I have posted the home addresses and home phone numbers of Asset Acceptance LLC Executives below. I would write them a letter and send it to their home addresses and let them know that you do not appreciate the lack of professionalisim thier employees have exhibited. Maybe give them a "friendly" phone call or two just to remind them that their employees were rude to you. They call you and write you after all don't they? Turnabout is fair play in my book. Here are the home addresses and Home phone numbers:

The President and CEO is Nathaniel F."Brad" Bradley IV in case you want to sue him for violations of the Fair Debt Collection Practices Act(FDCPA) or The Fair Credit Reporting Act(FCRA). I would also encourage you to report violations to the Federal Trade Commission, The American Collectors Association, The Office of the Attorney General in your home state as well as the Office of the Secretary of State in your home state. The state Office of AG will often file suit against them for violations. The state office of Sec of State has a trmendous amount of authority when it comes to regulation of business that operate within the states borders even if they only operate via the telephone. Best of luck to you.

The other rebuttal posted is quite right. I only want to add, that if indeed you do talk with them on the phone again, record the calls.

You do not owe anything to these guys morally, or legally.

Kurt, DO NOT pay them ANYTHING!!

Kurt,

These jerks are also junk debt buyers. They buy an old debt like yours for less than 1 cent on the dollar! That debt is past the statute of limitations for collections and they know it!

They CANNOT legally do anything to you!

DO NOT speak to them! If you do, you could re-affirm the debt and re-start the SOL and the 7 year negative reporting.

The best thing to do is to just change your phone# to an unlisted one. This will make that crackhead crazy!

DO NOT give them any information at all. NOTHING!!

You need to read the FDCPA and also go to budhibbs.com to read about these punks.

Go to the FTC.gov website and file a complaint online for the violations of your rights they engaged in. Do this separately for each violation, and again each time they call.

A CEASE COMMUNICATIONS request is good too. Send by certified mail, return reciept requested.

Good luck!
