AT&T Wireless At&t Neglects To Shield It's Customers From 3rd Party Offers In It's Stores Dallas Texas

On January, 17th 2013 I Purchased my new phone and a third party insurance plan through At&t's Swansea Mall location in Swansea, Massachusetts. At the time of purchase I was told by the rep I had two choices for insurance 1.) One was assurion which was a monthly fee for some basic protection and a small fee for replacement if needed. 2. The other was Protect Cell which I was told has an upfront fee ($139.99) with NO additional costs for a replacement if needed. 

On November, 17th 2013 my phones charging port became unresponsive. On November 22nd 2013 I called Protect Cell for my replacement. I was shocked to learn I would need to pay an additional $120 to receive a replacement. After swearing and yelling at the Preotect Cell Rep I hung up and called the At&t store I purchased the phone and insurance plan from.

Come to find out the store which was called "AMS CONNECT" has since changed names and employees, so the employee that sold me on a bunch of lies was no longer employed there. They said they wouldnt be able to help me so I called AT&T.

I spoke with the At&t rep who tried to convince me that at&t has no responsibility for what is offered in there re-seller locations! How is this possible? It's baloney! I walked into there store (Big at&t sign above entrance) to purchase what i was led to believe to be at&t services. I DID NOT receive a brochure, terms & conditions, follow up email or even a brochure in the mail within 2 weeks like i was told i would be receiving. 

This is very shady business practice and does not sit well with me. Regardless of cost, I have decided to take legal action against at&t since they are using there brand/logo in a way that makes potential customers assume they are doing business with at&t.

AT&T is correct... you did not buy the phone from AT&T so they have zero responsibility in the matter.  There is no reasonable expectation for them to do anything at all. Take a look at the contract you signed with Protect Cell for the replacement plan.  There is probably an exception for physical damage.
