I was talked into a contract with this company. I was told that it would be a 1 year contract and would be able to cancel at the end of the year contract or else it would automatically restart. So I followed the year contract and at the end of that year (the actual day of it being exactly one year) I went into the store to have the contract canceled. I was then told that I could not cancel it due to the fact that it was a two year contract not a one year. This young lady then moved on to the next customer without me being finished with my business.  So, I was pretty upset at the fact that I was lied to and then treated with bad customer service. I asked to speak to a supervisor which in turn she said she was the supervisor, so I asked for her boss and she gave me the card of the corporation. I called the corporation and received the same treatment. I was told that it was a two year contract and they were rude to me. I told them that I wanted to cancel my contract on the bases that I have had Horrible customer service. Then the gentleman that I was speaking with told me that the only way that I could get my contract canceled was if I paid the rest of the contract (which would've been a years worth) plus a $50 fee on top of that. I told him I would not pay to have my contract canceled when I was originally told that I could do it for free after my original year. I left it alone after that and now my credit has been hit with all this crap and has put a negative mark on my credit.

I experienced the same mis-treatment from At the Beach and Aspen Acceptance regarding my fiancee's membership. She began tanning at one of their location in Oklahoma City and she enjoyed every bit of it and what not; until she went to the doctor and was presented with results stating she had skin cancer. The doctor was surprised because she doesn't have sensitive skin and did not frequently tan.

She called and tried to cancel the membership properly by stopping the automatic renewal (which we did successfully) and canceling the contract by paying whatever fee we needed to. However, they ignored her request and did not correspond with her, she didn't say she was diagnosed with skin cancer by the way. After failed attempts, she canceled the payments at the bank. We then started to receive calls from Aspen Acceptance (debt collectors) saying she owed $980!

I then got involved and looked over her contract, the bank statements and obtained a report for the amount of times she has visited At the Beach. In the beginning, I wouldn't have minded paying whatever amount they wanted to cancel the contract but after several harassing debt collection phone calls, I have a new state of mind. If you are experiencing the same problems with At the Beach or/and Aspen Acceptance/Sun, you should know that:

1. Oklahoma does not require debtors to be licensed in this state in order to collect debt.

2. Even though, oklahoma does not necessarily have debt collection practice laws, we are still protected under the Fair Debt Collection Practice Act. (Aspen Acceptance has violated several of her rights)

If reasonable, I advise taking legal action; I will be. For the At the Beach affiliates, imagine this head line "At the Beach Harasses Skin Cancer Patient for Supposable Debt"

Even if you have contacted Customer Care in the past I encourage you to call again, regardless of what the previous conversation or outcome was as we do want to resolve our customer complaints in a way that is mutually satisfactory.
