In August of 2006, by order of the President of the United States I was called back to Active Duty Military service. The California Army National Guard screwed up my pay causing me a horrible pay problem. It took the finance people in the finance office four months to correct and stabilize the problem before I began getting paid properly. Being the responsible person that I am I immediately contacted my Mortgage Company, (Aurora Loan), to inform then of my situation. Originally, they were co-operative and understanding, Aurora made me set up repayment plans though my pay mess hadn't been corrected. We set up I believe three repayment plans, the first two I obviously couldn't keep because the pay problem was not fix.

Finally, when the pay problem was fixed I mailed in my first payment. Aurora returned my check to my home address, my wife calls me to tell me that Aurora returned my check. I contacted Aurora to find out what was going on? I was informed that they could not accept a personal check because our loan was more than 90 days behind. Even though the reason that I was behind was no fault of my own! So, I was then informed that I could send Money Orders, well I did so and those were returned to my home, again, my wife called me to let me know that the Money Orders were returned by Aurora. Again, I called Aurora to find out why those were returned. I was told by the representative on the phone that the Money orders had to be "Postal Money Orders", not like seven eleven Money Orders. Then I tried to just do payments over the phone, which they wouldn't do because I was more than 90 days delinguent. Then the phone rep. informed me that I could send in my payments Western Union Quick Collect. So, I went to a Western Union sent in two Quick Collect payments, a few days later I receive a letter from Western Union telling me that my payments were refused by Aurora Loan, to please come in and pick up my money.

So at this point I'm probably pushing six months delinquent, May/Jun 2007. My wife calls me to tell me that she started receiving lots of phone calls from people wanting to know what we intended on doing with our home? These people were calling because Aurora filed our home in foreclosure. Meanwhile, I'm deployed away from home and my pregnant wife is home all alone to deal with this nightmare. I got on the phone, the internet, and started leaving/e-mailing messages to Aurora Loan and with the assistance of a JAG Officer that was rattling the same cages that I was my complaint was elevated to the EXECUTIVE level.

The "EXECUTIVE LEVEL", sounds very important! But, just more of the same but handled by people who get paid more to Lie and Cheat!

When I spoke of a May/Jun timeframe before, mis-spoke after thinking about it - it was more like Feb/Mar ... So, my problem and complaint was elevated to the executive level. We received two phone calls, I received one from some guy named FRANCISCO, no specific message left. My wife received a call from some lady named KELLY, and again no specific message, "just that they were calling from Aurora Loan to discuss our loan". I returned both calls, I ended up leaving return messages to both parties.

Then a week or so later I received a call from a ---Ms. Colette Farley--- from the Executive Offices regarding my situation. She was actually pleasant, well I began to explain to her all the details of what "WE" were dealing with. I explained how I was forced to make payment arrangements by Aurora uncertain that I would be able to keep them because my pay hadn't been corrected. I explained to her that I had requested to have the four months that I was behind differed to the end of the loan, and my answer from Aurora was that they didn't do that. I explained to her how I requested to just have the loan rewritten, again my answer from Aurora was how they didn't do that either. I explaine dto her that on three separate occassion's I had Mortgage Companies that were going to consolidate our 1st and 2nd Mortgages with a low fixed interest rate long term, all that Aurora had to do was fax me a quick note on Company letterhead stating that our loan was in good standing with Aurora and that our Loan was protected under the Soldiers and Sailors Relief Act, and that Aurora refused to do that instead they sent me a letter which said the absolute opposite.

I than went into how my pregnant wife was home with my daughter having to deal with the bombardment of foreclosure JUNK mail, the HARASSING foreclosure telephone calls. I explained to her how the foreclosure tour bus had been driving by and stopping in front of our home. I explained to her how some man, had the nerve to knock on my front door because he wanted to view the home. Ms. Farley, claimed she was so moved and appologetic she wanted my wife to call her so that she could personally appologize! Hind sight 20/20, If she was really that moved she would have called her to appologize on her own.

Anyhow, Ms. Farley and I ended our first telephone conversation and she was going to look into a few options for us and get back to me. A few weeks went by, and I hadn't heard anything, so I contacted Ms. Farley. Ms. Farley said that she was still working the issue and was waiting for a ---Ms. Cathy Jarvis--- to call her back with some numbers. Unfortunately, at the time Ms. Jarvis was out sick. A week or so past, Ms. Farley called me and we contacted Ms. Jarvis, I went over the whole series of events again. I gave Ms. Jarvis a series of numbers off the top of my head regarding our monthly house expenses. I was asked to fax, some of my supporting documentation regarding the return/refusal of payments to Ms. Farley.

Once again, a few weeks pass, so I call Ms. Farley and she informs me that Ms. Jarvis had a Family situation that she had to leave to take care of, that they would contact me as soon as possible, I was told to be patient! A month passes, Ms. Jarvis and Ms. Farley contact me with some OPTIONS. Along with those options some numbers to go with them. They talked about the things that Aurora was going to wave on my behalf, they were going to wave the Loan Modification cost and Fee. They were going to wave, GET THIS, the foreclosure ATTORNEY cost and fee's, all my late fee's, so I let them finish. When they were done I calmly asked how much the cost for a Loan Modification, ($175.00). I ask how much the fee was for a Loan Modification, ($500.00).

Then I sorta ripped into them about there legal fee's, I basically told them that your waving something that your not entitled to begin with - ONE, because the Soldier and Sailors Relief Act, (SSRA) protects me from exactly what your Company did! TWO, your Company has internal infrastructure problems refusing the half dozen or so payments that it did to get us to thsi point. " (Why is it when DAVID makes a mistake it cost him money? Then when GOLIATH makes a mistake it also cost DAVID money? )" SORRY for the reference of DAVID and GOLIATH when I'm talking about the Customer -vs- Corporate America.

Anyhow, They actually came back with a pretty decent loan. I wanted to take these numbers and have a real estate mortgage person explain them to me in detail. I told them I'd get back to them in a few days. A week past and I called Ms. Farley and told her to get the papers started with the Loan Modification for the Principle & Interest Loan, Long Term Fixed. She said that she hadn't received the final approvals from her higher ups, that we had to wait until the approvals were done and finalized. She said that we would receive the final approvals for our options in the mail. Again, I was told to be patient, things like this take time, it took many months for it to get messed up it was going to take some time to get straitened out.
