Subject: Repair 1994 Nisson Auto, Purchased on Aug 30, 2000 Plate XXXX xXX

NoBull/Since 1951, WELL ! Our brief experience has been the opposite ALL BULL!

We would like to request another vehicle of similar $10,000 value. Let me explain!!!

In response to our request to have our 94 Nisson repaired in accordance to your purchase agreement dated 20/Aug/2000 - in addition we purchased for an additional $599.00 your PRE-OWNED MECHANICAL REPAIR AGREEMENT (VW-MASTERGUARD PLAN_NO: MM63266). In accordance to the agreement the Subject Vehicle was towed to your shop in January 2001. Before delivering our auto to your service department for repair, we were advised by Wayne Wallace, Earnhardt Supervisor that the vehicle was covered by your contract Pre-Owned Mechanical Repair (12 mo/12000 mile) Agreement #MM63266.

A few days after delivery of that vehicle to your service dept, we spoke to Eric, his response was that before work would begin we would need to pay $200.00 for tear down to evaluate repairs needed on the vehicle, we told him to HOLD IT, our MM63266 contract states a $100 standard deductible for POWER/TRAIN PLUS coverage. We noted that Earnhardt Service Dept, once before had repaired the drive train, only two days after purchasing the vehicle. The Power/Train, failed again in 4 months since being repaired by your Service Department. A good sign of it being a used LEMON vehicle that was sold to us.

Again, Jan 23, 2001 some very untruths came from the Earnhardt Service and Supervisor Staff,

They said that our 16 year old grandson had authorized it be taken to NISSON dealership for repair. After evaluation, they estimate it would cost $500.00\$1000.00 to get the auto road able. WHOA Nelly! what about the Contract MM63266 with your Earnhart Dealer??

For the past 4 months, the subject vehicle sits in our back yard near our horse barn, where it was towed. It is non mobile again, with a bad POWER/TRAIN.

We request $599.00 refund on MM63266 Pre-Owned Mechanical Repair Agreement which you fail to honor and we agree never to walk on Earnhardt Dealership property again....
