Avery Family Construction Derek Kunze Contractor Walked Away From Unfinished Project Pantego Texas

I hired the contractor Derek Kunze of Avery Family Construction to work on the house I recently purchased in Dallas. The initial contract totaled roughly $75,000 to be paid in 3 equal installments: Upon signing, middle of the project, and the last upon completion of the project. During the project, issues arose and other projects were asked to be added. The project start date was August 20 and the estimated completion of the project was September 19. The project ran over so we did not even move into the house until Oct. 1. Since we moved into the house, the workers have essentially stopped coming and nearly everything remains unfinished despite the fact we have paid Avery Family Construction nearly $95,000 to date--so essentially we're paid in full. 

Derek did come back to do a walk through of the property November 17 where he admitted the job was not complete and he would never recommend his services having seen the lack of quality and amount of unfinished work. A paint crew was sent to work on the house on November 19. They were only there one day and left the project far from finished--I later followed up to inquire why they didn't return only to find out it's because Derek never paid that crew and that Derek's last check to him bounced (he sent me a picture of the check). 

I spoke to Derek on Nov. 30 where he assured me a full crew would be out to the house by Dec. 2 at the latest. I followed up with Derek the night of Dec. 1 to confirm (no response), the afternoon of Dec. 2 (no response), and for a final time on Dec. 5, also with no response and have still not heard from him. 

At this point, it is safe to assume Derek Kunze and Avery Family Construction have no interest or ability to finish the job I paid for. This experience was completely unprofessional.
