I signed up on the internet about 6 years ago for credit cards services through LeaseComm. They told me that my business would be booming after a few weeks. So just starting my own small business this sounded great. I applied and signed the agreement to take the software that was provided from LeaseComm.
I had the software for three or four months. I did not make anymore money by having thier credit card software so I contacted them. Told them that I was paying out more in thier fees then I was taking in and could no longer sustain the loss. They told me that they understood and if I sent back the software that the agreement would be cancelled. So I sent back the software to LeaseComm. I thought that was the end of the story.

Two months later I recieved a letter in the mail from Axin Financial Services stating that I was behind in the payments for the LeaseComm lease. I told them that I was not behind because I sent back the software for the credit card services and was told that I no longer was part of thier agreement. Well the guy on the phone from Axin told me that I signed the agreement and there was no way that I could get out of the lease. It was a contract and I had to abide by it under law. I told him that there was no way that I was going to pay for something that I no longer had. He told me that they would come to Maryland and take me to small claims court and get the money if I refused to pay.

I told the guy that if he sent me the software back, and set me up to take credit cards again, I would have no problem paying them. He told me okay. Well months went by and no software arrived but I did recieve over another letter stating Axin was getting ready to sue me over the lease that I had signed.

I then got on the phone again and called Axin. It was at this time that the guy on the other end got loud and started yelling at me that I was a loser and that I never had the intentions of paying this and now he had no choice but to take me to small claims court. I actually told him to go ahead, that I would produce the reciept for the software that I sent back to LeaseComm.
This went on for a better part of two years. I would not pay these people a dime more until I got something in return and it was apparent now that they did not have anything to send me. One night I called them after getting another threatening letter basically telling me they were going to sue and take me to court. I got on the phone again. I finally was talking to someone that understood what had happened. He agreed that there was no product that I was going to recieve. I ask him if he would take care of this and he politely told me that he would take care of it. I also ask that it be removed from my credit reports. After a few weeks I checked the credit reports and it was gone. Amazing, they finally got it right and they took this off and I was no longer in debt to them.

This was in early 2000. In the meantime I have purchased three new homes and not once did Axin come up anywhere and I did not hear from them. In September 2003 I purchased another new home. Axin was no where on any of the credit bureaus reports. I bought the home and had been in the home for about 10 months. It was now August 2004 there or about.

I wanted to refinance my house for extra cash to do some work we had wanted to do to the house when we bought it. Guess what, Axin was now back on the reports and reported that I was a bad payer. They reported me the lowest number on a credit file.
It was a shocker to me and my wife. So we did an inquiry as to why it was on there and that it should no longer be on my reports.

This is when Axin started again with the letters. After 4 years they are once again stating that I still owe this money to them. It has been actually been about 6 years since the entire thing started.

I once again this time wrote a long detailed letter stating why I did not owe them the money and what had transpired over the past 6 years. That was two months ago now and I have not heard from them since I sent the letter. Now I do not know what is going on and I do not want to stir the pot with them. But they are still showing the bad credit on my credit report and it seems I have no recourse about this. I am frustrated beyound belief and do not know who too ask about this. I actually found this site by accident and saw all these files about this company along with the others that I have read. I am willing to be part of a class action lawsuit. I still have not given them dime, am not out any money yet and do not want to be. I just want at this time is to have it removed from my credit reports!

The complaints about Leasecomm are so bad that the FTC has established a web page just for them at www.ftc.gov/ro/leasecomm

You can also call the FTC at 1-202-326-3445.

Please visit the FTC site. It's very enlightening. It says that as part of the settlement agreement Leasecomm must "invalidate illegal provisions of existing contracts, including waivers of defenses....cancel and cease collections on approximately $24 million in final court judgments....require that Leasecomm give consumers who are the target of more than 2,000 pending Leasecomm lawsuits currently filed in Massachusetts the option of having the suit conducted locally...."

Someone named Glenn Harrison has created his own website to explain how the Leasecomm operates. You can get to at leasecomm.org.

You can get them to stop

First, file a complaint with the Federal Trade Commission. They are supposed to be regulating this company per a court order from last year. This same court order stated that Leasecomm and their agents were to stop all threatening collections practices. It is illegal to threaten to take legal action and not have the legal authority to do so. (Fair Debt Protection Practices Act.) Also, you need to file with the credit reporting agencies a dispute. If they do not respond within 30 days they have to remove it from your credit report. Even if they do respond it seems like you have enough proof that this is an invalid debt. Also dispute the debt in writing to whatever company is trying to collect it. Then, if needed, call an attorney. There were supposed to stop this crap over a year ago and they have not. Don't give up you can win against this company.
