B&H ripoff, sold usedone as new New York

I ordered new nikon 300mm telephoto lens for $900 and some other parts for my camera in Jan 9, 2004. They sent used lenes so I asked new lens. I got their permission to return the used lens and sent it to the seller. Later, I received another lens but this one also is used one. I paid $1430 for the product and shipping. I also paid at least $350 for customs duties and fees.
I asked them full refund or send brand new lens but they declined both.
The reason they explained was that the first lens that I returned was perfect condition and has no defect. They did not mensioned whether that was new or used.
I did not took photo of the first lens, but I have photos indicating the second lens is used one.

On Jan 9 2004 Byungyil orderd a Nikon 300mm f/4 DAF-S ED-IF lens. We shipped him lens serial # ####685. It was brand new when shipped to him and shipped in exactly the condition as it was when we recived it from our supplier. No one here opened and inspected the lens before shipping it to him. When he asked to exchange the lens for another, we promptly generated an RMA number and effected the exchange as soon as the first lens was returned to us.

On Feb 10 2004 we shipped another brand new lens, serial number ####509. It too was brand new and shipped in exactly the condition it was in when we recveived it. The possibility that two of the exact same lens, selected from our inventory at random, would exhibit the same flaw is remote at best. Nevertheless, when Byungyil said he wanted to return the 2nd lens, we did not hesitate to accede to his request. In fact he did not return the 2nd lens and we presume he is satisfied with it.
