After two years of paying for a membership and not going I tried to cancel my membership only to find that I had been tricked into signing a 5-year contract. The salesman gave me the impression I was signing a month to month contract. No mention was made of a 5-year contract or the fines that would come with a cancellation.

Then came the many threatening phone calls. Then came the messing with my credit report. Then they turned me over to collection agency's. I finally got rid of my phone and got a cell.

Today a marshall came as a representative of a collection agency to deliver an order for the garnishment of my wages. How can this be done without my knowledge and without me being served.

Two weeks ago they called my boss to tell him that a marshall would be coming. I felt it was harrassment and did not think for the life of me that they could have had the right to make a judgement against me without my knowledge.

I initially tried to quit bally's because I was teaching High School at the time and I was exhausted and poor. First year teachers are lucky to make a meager living wage in L.A. and they get paid montly which means very tight budgeting. When I spoke to them they gave a very rehearsed speach about my financial commitment to them.

I have asked for a copy of my contract, but I assume I signed it and that they have some standing there. But, the fact is, I signed without it being explained to me.

The actual debt collector is not Bally's but someone they must have sold the contract too.

Somehow they have recieved a judgement against me and I am now looking at the wage garnishment papers. I called them and they were clearly in the business of making money in this manner they were rude and snotty.

I am so angry I can't think of anything else at the moment. I will not give these people a cent.

I clearly waited to long on this and I am now at a complete loss as to what I should do next. I did think they'd get tired eventually. I did not think I would have to suffer the embarrassment of this coming to my work place.

The bottom line appears to be that you signed a contract specifying 5 years. If that is the case, then it sounds like you're stuck. Get a copy of the contract from them and make sure what it says.
