I joined Bally Total Fitness 05/25/2004. Membership payments paid for by Credit Card. I never used the club after the first week. I bought my membership and paid it in full. I then called Bally Fitness to cancel my membership. It is clear that you think you can just continue to take my money over the internet, but a person cannot cancel membership over the internet.

I kept receiving monthly notices that informed me money was taken out monthly for dues. I returned the first and every email after that saying I wanted to cancel my membership. That started in November. Since November, Bally has taken at least $75.00. I only found out recently by reading the finest print I can read that I have to cancel by phone or regular mail. I should have been advised of that in November, 2007. Now you think you are going to keep the money that you took without my permission.

That would be FRAUD. You should be made to refund my money and pay a fine for unfriendly business practices. Where is the common sense that you can sign me up on-line, take my money on-line but cannot cancel on line and don't inform the consumer outright. Since I have to go through hours of labor, I should be reimbursed for my time at $42/hour, my work pay. I'll mail my cancellation notice to you. I'll call my credit card and engage the services of an attorney, write to the States Attorney General, and file a complaint of fraud with the courts. Or, you can refund what you owe me.
