December 2009 Donald received modification papers with deadline to send back by January 5, 2010.  He signed and had notarized Dec. 31, 2009 and sent back in envelope provided from Bank of America.  Prior to this contract being sent we were on 3 months trial payments $1,629.05 we made all these payments on time and correct amounts.  We called BAC home retention department and they said keep on making those same payments until the new payments amount come in.  We began making the new payment of $1,777.95 on Feb. 1, 2010 and received the agreement back signed by James L. Smith MERS nominee for BAC Home Loans Servicing,LP April 2010 it has been over 6 months and they put our home back into foreclosure process again because they said escrow department is messing with our payments.  Our money is being held instead of applied to loan agreement.  We call several times every month and are getting the run around.  I was told by Nate who works at Bank of America that other customers are complaining about the same thing.  We've spoken to over 7 supervisors concerning this mess and non has helped us yet.  They keep escalating e-mails to different departments and nothings done.  We are part of that Country Wide lawsuit and have asked several times is this fraud?  The lawsuit is because a former employee sold people information for money.  I wrote Sigtarp in August 2010 sent it through USPS.  I wrote Bank of America in August 9 2010 sent it through USPS and still haven't gotten a response yet.  I contacted Sigtarp several times on phone no response at  all.  I'll have a big lawsuit if my home is foreclosed. 

Belinda contacted Florida Office of Financial Services. 
I keep records of every call, letter, fax, etc.
Do anyone know what else I could do?  We're in our home currently and intend on staying? 
How can our government let banks do this?

It appears that BofA was selected by the 'big-shots' to be the bank that received the bulk of the toxic debt, in my opinion. You can 'Google' this- FRONTLINE: BREAKING THE BANK, and watch it on the web for proof.

Your best bet is to contact ALL of your Local News stations in your city and get a copy of your Ripoff Report to all of their Investigative Reporters immediately. Include your phone number and email address. Maybe someone will help you.

The answer to your last question is this: Our government is being controlled by the Federal Reserve. The Federal Reserve is simply a cartel of bankers, and others, who can do whatever they want.

we bought our home july 2005 our first payment of 595.16 was due oct 1,2005 we couldn't make the first payment because we were evacuated for hurricane rita they suspended our account for 3 months told us that we could make payment arrangements later there were no computer use, no lights phone i was able to get online later and try to deal with this, talk to a person with countrywide who was the morgage holder at the time, told us to apply for a side FHA lone, to catch up on payments, then told us that we had to be 4 months in the rear in order to qualifiy so we waited and applied, we were denied then we were making payments and they started sending us letters to catch up on lone telling we needed to pay 800.00 a month we couldn't afford that much a month, but the payment we were sending were not being applied to the lone they were applied to the escrow acct and we were still behind, so we filed chapter 13 bankrupsy.
later Bank of america took over during this time. the payments there were getting was $711.00 a month through chapter 13, during chapter 13 they recieved about $59,000 in the beginning of our home lone the starting ballance was about $75,000 they still say we owe $69,000 i got all the paper from our attorney of payments that were made, and papers from bank of america and most of those payments say misc payments what ever that means but a lot of payments were not applied to the lone, now we are waiting on home retention they still send us monthly statement saying $1400. due whatever that means we are so confused i want to get a attorney and file lawsuit, i need to get in that law suit filed on country wide home loans if someone who reads this can send me information on that would be appreciated,

...I really hope and prey that you get to keep your home. It seems according to your report that you have done everything you can and as instructed to do.

I wish I could offer any further advice to help..but it may take a class action lawsuit if the gov/feds do not do something..and FAST.

If you want some idea what is actually going on, copy and paste the following web address into your browser and watch the clip. Is is Jon Stewart so it is sarcastic and humorous, (with some fairly explicit and figurative language and diagrams), but to those who are victim to this convoluted system (aka "clusterf*@K), it may not be very funny. I laughed, but it is with disgust as well. Maybe you will get a chuckle, you may need it. It explains what has been going on pretty clearly and rationally though, and in these times that can be refreshing...

Our so-called 'government leaders' have no idea what's really going on. The banks are obviously hiding a lot from our elected officials.

Keep in mind that there are over $595 TRILLION in derivatives out there. A lot of it must be connected with the housing market/mortgage industry in the USA, right?

Then 'Google' this- FINANCIAL CRISIS A TO Z- VIDEO- BUSINESS NEWS, and watch that video that recently became available.

*Send all of your information to your Attorney General right away, and send copies to the New York Attorney General, Andrew Cuomo. Mr. Cuomo should know what's happening to people all over the USA because many of these banks have their headquarters in New York.
