Bank of America Bank of America erroneously paid mortgage taxes, harrassing me with threatening letters more than 2 years later demanding refund. Charlotte, North Carolina
Bank of America sent me and my wife threatening letters saying that Bank of America paid our mortgage taxes on our behalf for the year of 2009 and 2010. We thought that was a scam until we called them. Our mortgage loan lender is Chase and we pay a monthly escrow to Chase. Every year weve received form 1098 from Chase showing theyve paid our property taxes. Weve never had a mortgage loan with Bank of America. Their errors continued to happen for three consecutive years without them ever validating their escrow logs vs. the parcel holders ID.
Bank of America threatens us to report us to a credit collection agency if a response isnt received. We have worked very hard to achieve good credit and cannot have threats, valid or invalid, destroy our credit standing.
Bank of America has requested full refund for not only 2009s erroneous tax payment, but also 2010 and 2011 tax payments. I am not in the financial position to be able to afford to pay for a tax bill for 3 years. My monthly escrow payments are around $200 and I cant afford to make this huge amount
This is totally Bank of Americas mistake
Nobody informed us about these payments until 2012
We have spent hours to be able to get in touch with mortgage department in Bank of America and nobody return our calls or co-operate with us. When we reach them they hold us for hours. Not only we have to spend our time to reach them for their mistake but also we have to pay huge phone bills.
We dont know what to do. We need your help. Please help.

Your report is very confusing. First I know BofA has issues but I don't think they would just randomly pay Property Taxes of people who does not have a Mortgage and Escrow Account with them. So this is either an error or you are leaving things out.
Do you have any loans or accounts currently or in the past with BofA? Do you happen to be a Co-Signer on any BofA loan?
Does your County show that the Property Taxes have been paid? If Chase and Bank of America are paying your property taxes you should have quite a credit building up.
Does the Parcel ID that they say they are paying match yours? If it doesn't do you know who owns that property?
Have you actually gone into a BofA branch instead of dealing with them on the phone?
Have you looked at your Credit Report for any possible Identity Theft issues?

I have a mortgage with Bank of America.. I did not have an escorow on my mortgage and Bank of America paid my taxes in error. My mortgage payment doubled. I spent hours on end with CSR and was told completly different stories by each rep. Finally I made all contact through my Bank of America bill pay email. Well, each email contradicted the previous. Finally I was told that I need to call my local tax office and provide proof that my taxes were not delinquent when B of Amer. paid them. I got a letter from my local tax office with proof that my taxes were not late when they were paid. I sent the proof to Bank of America.. after all of that ,The response I got from B of America was.. "I'm sorry but there is nothing we can do, you will have an escrorow for the life of your loan. I have a hard time even writing this, there was so much time involved and different stories told to me that it infuriates me. I am on a fixed income and simply can not afford the payent I have to pay now. Bank of America told me to file for a loan modification if I can not afford my payment. I could afford my payment until THEY jacked it up by double.. I am now paying double taxes to bring my escorow to a non negative balance. I always paid my property taxes on time. I would use my income tax refund each year and that was the only way I could afford it. Bank of America does not treat their customers as individuals, nor do they train their CSR's properly. I spoke to about 14 different reps and each of them gave me a differnt story..

You can contact all of your Local News stations in your city and send them a copy of your Ripoff Report. Put it to the attention of 'Investigative Reporter'. Email copies and send hard copies through the mail.
There is a chance that someone will contact you. It would be safe to assume that if this happened to you, it might be happening to other homeowners, correct?

Your post is very confusing and you contradict yourself.
You either owe the money or you don't [legally].
If you do not have a legal contract with Bank of America on this, you have nothing to worry about, and they cannot [legally] report anything to your credit.
Then, you go on to throw the name of Chase Bank in there and to say that you cannot afford to pay 3 years worth of taxes.
If you don't owe the money, why would you be concerned that you cannot afford it?
Why would you even consider paying something you don't owe??
A very confusing post.
The best part is where you claim huge phone bills for sitting on hold for "hours". [Highly doubtful].
All major banks and mortgage companies I know of have toll free numbers that cost you nothing. So, unless you are calling from your cell phone, I can't see the huge phone bill thing. No home phone??
You really need to get a grip on reality here.
Maybe read what you sign and agree to?
You either owe the money or you don't.
Which is it?
