The banking giant Bank of America continues to rip off it's customers after their class action law suite settlement.  I was unaware of the class action law suite until recently; however, I am painfully aware of the tactics used by Bank of America to continue stealing from it's thousands of customers.

I check my account almost daily.  Recently Bank of America has changed it's on line format. There is the screen you see when you first sign into your account and then there is the AVAILABVE BALANCE HISTOR screen.  This screen shows balances with holds and without holds.  If there is a pending hold on your account and there isn't enough money for the pending or holding funds, Bank of America will access your account $35.00 in overdrafts for each occurrence.  Example:

Date   Transaction  Type           Transaction Description   Amount                       Balance with
Auth & Holds
Balance without Auth

09/14/2009 Debit CHECKCARD 0911 KRYSTAL 00001529 MEMPHIS TN 4164079256630216681297 -$9.24     -  $24.91 $35 Fee triggered $76.70

It is not that the money wasn't there, Bank of America chose to charge $35.00 on a possible overdraft that had not occurred.  If that was the worst that they could do, they posted the over drafts before posting the the actual transaction causing an even bigger overdraft.

Now they say if you account is in overdraft status for 5 days, they will access an additional overdraft fee of $35.00 on top of the money they have already stole from you.

I have my first time to talk to a representative that can explain this rule to me that makes it ok to steal from your customers in such a way.

It would seem that Bank of America is recouping the money they used to buy the other banking giant and the BONUSES paid out to the big wigs as a result of that transaction.

How is this bank able to continue to get away with this after the troubles it has faced concerning this matter???????????

If there is another class action suite to be filed please contact me.  I want to be one of the first on the party wagon to fight this fight.
