my mom was receiving military pension benefits from my dad's service in the army, after he died. $652.00 per month.


When SHE died, 3 years later (thanksgiving day, 2008) Bank of America stated I had taken this pension money from her account and spent it.


I explained to the branch manager that I did not even know she had an account with Bank of America, so how could I have done this? He was extremely rude to me, and told me that essentially, I was a thief.


I simply mailed back each and every letter they sent, over this past year, with the address label blacked out and "DECEASED, RETURN TO SENDER" label on it.


I never had the money. Over and over I have explained this to Bank of America, in person and on the phone and today, I was notified they have placed me into COLLECTIONS. Talk about ruining your credit. BOFA had that money, and is not paying it back to the government as they should.


Instead they are accusing me, and trying to place the blame on me. Thanks very much, BOFA.  Your business is failing and this is one of the reasons why: Consumers, "We the People" are outraged at the behavior your branches exhibit towards customers. This caused us to move all our accounts to other banks.


NEVER, but never, trust BOFA. They don't care about you. It's all about their money. RIPOFF. 


Collections, indeed. We'll see.

Normally I do not believe in Government interference in anything..but in the case with what the banks have been getting away with...now more then ever we need some protection.

In this case...and many cases..the bank assumes the role of police, FBI, investigator, lawyer, judge, jury and executioner. To the banks...everyone is guilty until proven innocent...and the bank can do no wrong. If in a rare case the bank admits to error...they are charged no fees or fines...regardless of any inconvenience or financial hardship they have caused.

With that said...I don't think the bank can simply accuse you of cashing in on your mothers army pension after she died, without some kind of proof.

If the bank can not present proof that you were receiving and cashing these pension checks....I believe it would be safe to assume you have legal recourse for any damages at all caused by the bank due to this situation.

If I were in your shoes...I would seek out an attorney that will work on a contingency basis...since I feel if what you state is true..and the bank is ruining your credit..it is possible this case may be worth a substantial amount. Off the top of my head..and I am not an attorney..I can think of several possible charges against the bank in this case.

 I do not see how you can lose this case if you are being 100% honest with what you state in the complaint.

Without the need for a lawyer, if you don't want the pay the money, simply return to the branch in question and once again speak to the Branch Manager. Explain to them that you are not a BofA employee, which means you do not have access to their computer systems.


Remind them, that as the Branch Manager, surely they have access to their own computer system and therefore have access to the account in question. They should be able to quickly and easily retrieve all of the most recent account activity and follow their own paper trail of what happened to the money.


Inform them that until they produce and show you documented proof on paper of the account activity, proving that you did in fact take the money, then you politely suggest they cease and desist with all of their outlandish harassment and collection activity. I'm not talking about them producing copies of their drummed up letters they mailed. I'm talking about statements and computer printouts of the actual activity of the account in question.


Finally, inform them that you do in fact have a lawyer who is ready with the necessary paperwork to proceed with a lawsuit. You can even throw in that you have the assistance of the government for good measure, and see if that won't get them on the good foot. You have to convince them you're not fooling around here. This is ludicrous.

It's only now that people are really starting to catch on. They just recently pulled the same BS with me, they charge you random fees but don't put it on your statement so that you can't prove it. If you actually balance your check book, you'll notice that they do it but they make it almost impossible to prove unless enough people come forward...
