Complaint Review: Bank Of America

Bank Of America opened checking acount and deposited at ATM my friend diannas 2 good paychecks for 629.01 and 258.58. I withdrawed from Atm 580. to pay her, (she paid me 300. to drive her to nogalas az.) I use debit card for spending 280.the next 2 days. Atm then tells me i am overdrawn by hundreds of dollars Tampa Florida

My friend dianna came over on 12/o6/07 at 9pm and wanted me to take her and her fiance to nogales in my taxi for $300. that night but the only way to pay me was to deposit her 2 pay checks to my bank of america checking account that i recently opened at the ATM machine, they were for 628.01 and 258.58 , and i know her boss so i knew the checks were legitamite. I then withdrawed 300. twice from different atms on the way to nogales to give her 586.

I used my dedit card several times the next 24 hours getting gas and food and cash for a total of 280. ,leaving me with a 40. balance. then i used it again on 12/08/07 at a atm ,and it said i was overdrawn by over 1000.. I called bank of america and they said that the 2 checks for 628.01 and 258.58 that i deposited weren't reconized as deposits because that person who the check was made out to was not a signer on my account and, that all the debit card transactions the last 2 days were done on a negative balance so they charged me 480. in service fees.

then they didn't want to give me back the 2 checks so i could cash them at wells fargo bank and get the money to put back in my checking account. a few days later i recieved the check for 628.01 which i cashed right away. B of A refused to take off the 480. in service charges or return the other check for 258.58. , so i didn,t deposit anything to tat account. 1 month later B of A closed my account saying i owe them 1361.02 including 486.96 in fees.

Now i get leters and numerous calls from collectors. I also cannot open a bank account anywhere now because of Bof A. This bank is a big rippoff , thet never gave me back a good check for 258.68. Thats got to be fraud. Also 8 years ago i was living with my father and taking care of him. He had heart and back problems. I had a joint account with him at B of A and went to Las Vegas with him and won 10 thousand dollars.

I deposited 6,000 in the joint account. I month later he fell in the shower and broke his back and couldn't get out of bed. My sister Laura had power of attorney and closed all of his accounts including the joint account i had 6,000 in. 2 weeks later my sister forgot to give my father his heart medications for 2 days and he died in my arms of a stroke. My sister got everything including 2 houses and all his cash. i got some furniture. B of A wouldn't return the 6,000 to me either because of the power of attorney paper. B of A has kept me broke since 2001, they are legal theives.

You should possibly consider giving someone financial power of attorney for yourself. You have absolutely no clue how to handle a bank account.

Even though the checks may have been good:
1) They were paid to someone who wasn't on your account.
2) They were deposited at the ATM on a Friday night. The earliest the funds could have possibly been drawn against would have been Tuesday.

If you were taking care of your father, why didn't you give him his medication?

Your father would have had to sign the power of attorney. After his death, the power of attorney is no longer enforce.

If he didn't have a will, his assets would still have to be probated and an executor assigned. If he did have a will and left them to your sister you are SOL.

You are the cause of your own problems. BofA is just your scapegoat.

as you clearly do not know how one works in the least. What made you think that just because you deposited 2 checks, that they were 1) good to begin with and 2) would cleary immediately? You spent money way, way, way, way before you had it.
