BANK OF AMERICA PERMITS UNAUTHORIZED FIRMS TO MAKE DIRECT WITHDRAWALS FROM MY CHECKING ACCOUNT RIPOFF! RIPOFF!Bothell Washington
Bank of America dishonored its agreement to return my canceled checks to me. Bank of America made subsequent deals with vendors allowing them direct access to make withdrawals from my checking account. Bank of America ignored my prior written demand to prevent any EFT withdrawal by any vendor.
Bank of America allows vendors to destroy my checks and to have direct access to my checking account to withdraw my funds. Bank of America statements show merchant EFT transfers but not check numbers, and sometimes transfers to other than payee on check.
Reconstruction of my bank statement is difficult.
I previously notified Bank of America in writing to refuse any attempt by any firm for any direct access to my checking account,and no firm has ever been authorized by me to make any direct access to my checking account, but Bank of America continues to abuse its trust.
Bank representatives told me it as a "computer problem" they can not fix, and that it is impossible to program their computer to prevent these unauthorized withdrawals.
I want Bank of America to return to me all moneys withdrawn from my account by unauthorized firms, to permanently stop the buse of account and to stop violating their position of trust.

Banks are required by the National Automated Clearing House Association (NACHA) to accept direct debits from your account provided that the merchant has the correct routing and accoutn number, and corresponding personal information (name, address, etc). No bank can stop accepting these items simply because you prefer to deal exclusively with paper checks. It is the merchant's decision to convert from a paper check to an electronic item.
If you wrote a check to the merchant, you have authorized them to withdraw funds from your account using whatever method they prefer based on the information you have provided. You have a relationship with the merchant, therefore the charges are not unauthorized.
If you believe that a merchant has charged an amount that is truly incorrect, contact the bank and request to file a dispute. Banks often have automatic chargeback rights with merchants, as long as you notify the bank with 60 days of the transaction.

Since Check 21 has gone into place, some of my payments are actually slower clearing than they were before. Used to be that my mortgage payment cleared the same day I made payment or the next evening. Now it is taking up to three business days and the only difference I am noticing is that it clears around 3 or 4 PM instead of at midnight. I have fortunately only seen one "glitch" with Check 21 and that is when funds were captured, there was a server problem of some sort and the same funds were captured twice (but resolved within a day). Any one else notice the change?

Returning Paper Checks

John... unfortunately you no longer have a right to get paper checks returned, under federal law. At this point in time, a bank may or may not return them... IF... they themselves receive the check back from the original depositing bank.
In the very near future you will see the number of institutions returning check dwindle to none, so you might as well get used to it. Also be prepared to see your checks clearing on the same day they were written.
As for fraudulent withdrawals, all you have to do is go to your bank and file an affadavit of fraud, the same as you would if they forged a check.
As much as I would hate to defend them, I believe them when they say there isn't a way to block electronic transactions. These come into that bank by the millions every day, how can they sift yours out for return? How could they know that you didn't authorize them? I work at a very small FI, and we would have to tell you the same thing, for the same reasons, although our electronic transactions number thousands, not millions.

Start with the companies you are giving the checks to. I understand you have argued with the bank and have'nt gotten very far. Unfortunatly a lot of merchants are doing this more and more. Most credit card companies do this. We have a supermarket here that does it, but they hand you your check before you walk out the door. Good Luck!
