My company started using this company in 2004 and in all honesty I did not do my homework before selecting this company as our credit card processing vendor. We were a start up company then and were very inexperienced in the difference between good and bad credit card processing vendors.

Hind sight is always 20-20. Without writing a full documentary their fees are high and their only means of staying in business is to pick up new companies who don't know any better. I had a chargeback against our company which we were ultimately proved to correct and the other party lost. Meanwhile Bankcard USA sat on our money and Jeannie in risk management and the "Hardy boys" didn't like the fact that I protested and also that our attorney sent them a letter in the same light.

While all of this was going on out of nowhere comes a letter from these people terminating our service due to "presenting transaction records for transactions outside the normal scope of your business". The service was terminated the same day as the letter. In other words we grew and the naturally the amounts charged by our customers was larger than the first day we did business. The facts are we had charges higher than our initial application almost from day 1 in 2004 when we started the service.

The reason for this report is to tell anyone who is currently doing business is to get out while you can as they obviously pull the plug on a whim and without warning. I don't know why California has not shut down this business which operates like they are in a third world country. By the way our primary bank picked up our credit card business in one day and they are much cheaper and very customer service oriented. These people and their unethical practices should be shut down.

In reviewing the merchant's complaint above, we have concluded to the following:

1. If the merchant felt that their rates and fees were too high with BankCard USA, we do provide a department that can help reduce the merchant's rates and fees. The merchant could have requested to have a Rate Reduction. This would have helped the merchant get a better understanding of their monthly rates and fees.

2. The merchant is solely responsible for any potential chargebacks or retrievals that may occur with their business. BankCard USA reviews these chargebacks and makes sure that the merchant takes care of them. If a merchant loses a chargeback, does not take care of it or if the merchant's business ever closes, BankCard USA becomes liable for these chargebacks. And in some cases, BankCard USA has the right to hold funds from the merchant's processing to protect us with any future chargebacks and/or retrievals (and this is on the merchant's signed merchant agreement). Please have the merchant refer to a copy of their merchant agreement. A copy of our agreement is also posted online at www.busams.com.

3. When a merchant applies for a merchant account, they are approved for certain parameters-their monthly volume and average ticket. If a merchant goes above their approved parameters, funds are held pending verification of the transaction. If the transaction is deemed legitimate, funds will be released back to the merchant. This process is done to also protect the merchant from any fraudulent activity from potential fraud or customers with stolen credit cards. It might not seem like it, but it is for the protection of our own merchants.
