Complaint Review: BARACK & ASSOCIATES

Yes, these jerks have been harrassing me for several years. At first it was for a Montgomery Ward Judgment from back in the mid/late 90's. I settled with Montgomery Ward's Attorney for their Bank, Montogram Credit back then, and paid the debt off in 2001 and received a satisfaction letter.

Borack and Assoc. started calling me five years later on behalf of another collection agency for the same debt. Since I paid it it went through approximately 8 other collection agencies. It took me two years to get them off my back after producing and faxing this satisfaction letter to them several times. They still kept calling me as if we never spoke before and had no knowledge that this debt was satisfied and proper documentation was sent to them. One day recently they called me every 15 minutes with their recording to call them by 8:00pm with an urgent matter. Most of the time when I would try to call them back all curcuits are busy now recording would repeat and tell me to try again later. Boy was I fustrated.

Recently I filed bankruptcy and supposedly they were notified to cease and decease. They have still kept calling....Now as of yesterday they are calling to tell me I have an outstanding judgment against me with Household Finance. On my credit report(s) I show no judgment with this company ever. Wouldn't I know, or have been notified of this judgment. It does not show in public records I owe this debt. I did have a 2nd mortgage many years ago with Household Finance but shows debt was paid in full, and I was never late on a single payment. This shows on all three credit reports!!

They told me they are having someone come out and serve me papers to sepeona me to produce records of my assets. I told them I have no knowledge of this debt and I am not going to attend. They said they will find me in contempt of court, so I gave them my Bankruptcy attorney's phone number whom also has a doctorate and she ran for the state senate in 2006. They made fun and laughed and snickered with the supervosor listening on the phone saying what attorney has a Dr. in front of their name she must not be very good or litgitimate.

It took me about 40 seconds to get my attorney's phone number and they harrassed me for not having her number memorized. At this point I told the lady on the other end of the phone "to listen to me little Missy" (a term I use when my 18 year old daughter thinks she is too big for her britches) and tried to defend my innocense and to no avail she cockcalled and defamed my character.

This is a collection company run by a sleeezy attorney whom is used to breaking the laws in "The fair credit collection pactices law" and they don't care and seem to think the laws do not apply to them and they are untouchable. When I get through this I am going to start a class action suit against them. Do I have any one interested in joining me in this regard. It is about time they pay the price for illegally harrassing people and claiming phantom debt that is uncollectable , or debt that has been paid off and satisfied. These poeple don't care if debt is 20 years old and/or not legitimate. They will add on any fees and interest they want. I want this company fined and brought to justice. They pressed and rang the wrong buttons!!! If you have any comments you're response is appreceated. I am not afraid of these people. If they can come after me on a daily basis for debt that is not owed I can only imagine what they are doing to others with legitamate debt. This does not give them the right to do as they do and harrass anyone.

If you receive this number on your caller ID 321-282-4111 GOOGLE IT. You will find a slew of other alarming complaints with this attorney based collection company. They do not follow proper proceedures for collecting debt. Thank you for reading, I hope this helps someone else!!

They served me a sepeona on a faxed paper from "heaven sent" late at night, it did not even look legitamate. I was in the middle of a state exam online. Fortunately I passed, but I was so mad!! Thank you for reading. I have more to say but this is enough for now, you get the picture.
