I ordered a raspberry liquer flavored cheesecake for my wedding cake from Bay Bakery. During the first appointment with the bakery, the baker had provided me a sample of raspberry liquer flavored cheesecake based on my preference stated during the phone call to set up the first appointment.

After discussion with the baker over the order, she wrote out a tentative invoice with "raspberry" written on the invoice. I told ther baker I would call her later if I decided to go with their services.

I wrote a letter to the baker (copy on file) stating I liked the raspberry liquer flavored cheesecake sample and would like to use their services to make and deliver my wedding cake.

In July 2004, I received a call from the bakery telling me to pay the balance of my bill before August 1, 2004 because they were closing down for one week from that date. I completed this transaction on July 31.

On my wedding day, August 21, 2004, the wedding cake delivered was plain cheesecake with raspberry compote topping. This wasn't discovered until after the reception hall staff cut the cake to serve to the wedding guests.

on Sept. 15, 2004, I called the bakery to inform them of their mistake after the wedding. After a few discussions, the owner's wife, Virgine, agreed the wrong flavor was provided (confirmed by their baker) but because the cake was eaten, I was not getting any type of refund. After further discussion, she said she would talk to her husband about this issue.

I called back a few days later (9/17) to ask about the status of my situation and one of their employees (Barb) stated "I was told to tell you checks are cut the 15th & 30th of the month".

After one month (10/14), I did not receive a refund check so I called again. At this time, the owner said I would not be receiving a refund, turned the situation around to make it my mistake, told me none of his staff said they made the wrong flavor and said he did not care he provided poor service.
