I fell behind in our Beneficial personal loan payments, due to my job and heavy credit debt. Sometime I would work 80 hrs and some time less. I contacted Beneficial main office in Rochester and told them my situation and they said that would refiance my mortgage to get my interest rate down lower. Well that went on for 3 monthns and in the meantime the collection department from beneficial kept calling for payemnt.

Benefical also was charging interest on two separate loan. One loan was old and they gave me a new one and both were suppose to be combined but they never did so I am paying for two high rates on two different loans. In their disclosure you can only have one acct open with one interest rate at a time.

I then call the main office and they said they would contact the collections dept to let them know that they were trying to refiance me, and they never did. I then wrote a letter to the collections dept to make a payment agreement to pay a 100.00 until my fiancial situation got better and one of the collectors named Tanya Davis called me back and said if I agree to make a payment of $170.00 then I would be ok. I agreed and started submitting payment that was agreeded upon.

Two days letter I started receiving calls nd letters from a law firm Rubin and Rothman that represented Beneficial. I recently received a call from a Jackie Evans yesterday from Rubin and Rothman who was very nasty and her tone was very racist. He mentioned to me that it didn't matter about what payment agreement I made with benefical she was going to sue me no matter what and she told be I better not laught because there was nothing funny and she hung up.

I'm not one to play the race card, but she talked to me as if I was nothing. She aslo mentioned that she was going file a judgement against me to have my wages garnished which will so tragic for me.

I cannot afford them to garnish my pay check, I have 3 children other debt and making under $26,000 a year. I am still willing to make the $170.00 payment which is all I can afford so I am not sure what to do as of now. I am going to write the Better Business Bureau about my situation, before something major happens.

This is the Business Proposal of the said company Ourway Or No Highway Towing & Trucking Services Inc. that I plan to operate, if upon approval of your firm to lend the money. I do apologize of all previous delay of payments,
recent judgments, credit histories. Once you review the said business proposal, Im quite sure youll be pleased with the said business proposed and with the cash projections. If possible, you can lend the inquired loan asked and pro rated with all debts, previous loans. Once you decide on a positive decision, then give me a call, e-mail as soon possible. Hauling, frozen and non- frozen commodities, and towing, automobiles and small trucks.

Present or Proposed location;
The location is out Rochester, N.Y.; and wherever we purchase a building, perhaps out of Geneva, N.Y.

Existing or Potential Customers;
The geographic area is all 52 states, plus Canada and Mexico. Most of potential customers or contracts are commercial commodities shippers. With the type of vehicle, that I have is a straight vehicle and that will only carried local to regional, up to 50 to 550 miles or sometimes better. The commercial vehicle (tractor) will be traveling up to 450 to unlimited miles.

History of Business;
Our company does not really have a history yet. However, with the hardcore training I have in the past, I have a complete knowledge of the business or how to knowledge of getting started and paid out there.
I started building my business in May of 2002 and I been going to several places asking questions about the transporting business. Trying to receive different Quotes from

Business Financial;
As Independent Contractor, we do not do all the work of getting contracts, the workloads or anything else. Most our work is done by a transportation broker, to concentrate on getting my company and the lender paid in full as quick as possible. In the first 3 years.
We will be independent owned and debt free. Our net worth potential is or can be ranging from $ 1 million to $ 60 millions dollars a year.

Market Analysis;
The potential customer (s) will be commodities shippers, independent shippers, and or international shippers, never individuals. The quantities are large, uncountable customers.
Most contracts are industry that needs immediate motor or private carriers. The business margins is high, at the rate 100 commodities shippers over 50 of them will call upon my or our company to carry their shipment. The majority of the time your transportation Broker (s) will supply your company with loads, services, ECT.
Our strategy is through Internet, word mouth, and by other independent driver (s).
By advertising and through several accredited schools, we did our research and founded that with the market steadying growing, we can employed up to 1 to 10 employees in the 1st year and in the 3rd year we be having up 25 to 50 employees. We believe that our company will be the 50th top companies in Fortune 500 magazine. We believe that, we

can produce the following; a good pay scale, health benefits, pay holiday, and then perhaps paid vacations to compare with the others competitors.

Services & Competition Analysis;

What make my services better than the competition; competition out there is stiff, because of the high volume of shippers and carriers in the market trends, out 100 private carriers and I myself (1) one of them, I will have a hard fight on my hands first of all.

First of all my services will be dependable, cheaper, and efficient due to a smaller commodity services making sure that the consumer is 100% satisfied, a personnel service that provides, as than the bigger motor carriers.

I will be doing 95% No Touch Service this way it a lower insurance cost to us, than the other competition. My policy the quicker the better and less hassle free unloading while we waiting in the dock, get on the cell phone places call to my transportation broker for the next load to fit or my load capacity, if Im not already loaded, to prevent a down cash flow well be also be doing towing and road service repairs to the private sectors of consumers. In this area there is a few competitor companies out there, some of them lease their company vehicle to you at 20% up to 40% deductions from your pay check, without the options of owning the vehicle that were leased, right here in New York State. When you trade it in for new model, they start over with fresh new payments, leaving you a bigger bill; in addition, you are their employee, and never owning the vehicle. That is the good strengths about leasing from a major motor carrier(s), but what happen if youre terminated, now youre stuck with bill and no work, no job, and no commercial vehicle, and your ex-employer will not pay the vehicle bill. Owning your own vehicle gives you a little more leave way, first of all, you can contract your vehicle to a major motor carrier, but youre not self employed, and most likely its stop the process of owning your own company.

Now these large companies is targeting the same markets as I will, on where theyre have people calling them for loads delivered, and have stocks markets brokers, guiding their companies, which is their strengths, now their weakness is high volumes insurance brokers, a high overhead cost, several employees to get home. Our company does not have a high volume insurance cost, or high overhead, in the 1st year running.

Marketing Strategy;

Ourway or No Highway Towing & Trucking SVC (services) will operate as any other private and non- private motor carrier. Our strategy will be to operate at a lower efficient cost (per service) far from the rest of them out there, plus being a racial minority operating motor carrier, that will be in the top 50s of the most top trucking firms in the Fortune 500 magazine. That is our strengths first of all. Then most of our employees do not have to be trained to operate a straight commercial vehicle, in the first place, just simple road test to pass, well be operating tractor trailer trucks as well. In the five (5) year period well be looking for investors, becoming a dependable African American owned motor carrier company, the majority of the time, most shippers will contract us as their permanent carrier. Our services will be different only by having straight trucks, tow trucks and tractors, then the initiative road service that is provided, plus well be operating by cell phones services, and getting city, counties contracts.

Our competitors strengths are only that they are larger, more vehicles, more contracts, more employees and most of all are they have been in business longer than Ourway or No Highway Towing & Trucking SVC. Their weakness is that sometimes their payloads get there or not, due to more situations than any, and their other weakness is their services is not personal base business, with their customers, clients, employees. Ourway or No Highway Towing & Trucking SVC weakness is that we are brand new towing and trucking firm, were small towing and trucking company, a risk factor to banks, lenders, insurance companies, and the reason why we are risk factor to insurance companies, that we are new, to insured our vehicle(s). But once they see our name in their docks, roads and advertised, we believe that we will not have any complication. That when the adventure really starts.

Plus the competition have the technology, due to high volume of vehicles, their insurance cost is lower, their maintenances is lower, well be using each vehicle (s) 350,000 miles/3 years warranty from every vehicles, not waving any of them. Ourway or No Highway Towing & Trucking SVC, has its DBA and will be getting a federal trademark to prevent any complication or copy cats that is out there, only reason is because I develop Wal- Mart super shopping stores, didnt get the credit for it, nor gotten paid for it, right here in Rochester, N.Y. Ourway or No Highway Towing & Trucking SVC has been forming for (1) one year with a small budget, with can win determination (we wont loose), if by any chance after our attorney (s) does the search and do find out theres someone else out there with our name, then they are lying because I search the Internet already and found no one in May 2002, there is no one with the name, symbols (logos) as a towing 1st and trucking 2nd company. As we decused in the beginning, our policy will be a personnel base business (1st ) first of all, people attends to generate more business when youre personally friendly, dependable, neat , ambitious and to do more business with you than the larger companies, their employees just might be rude.

We will be hiring qualified drivers, the same day, once the equipment is in possession. Due to being a private motor carrier, the stability office structure is or will be one of those constructional type trailer office building, and a large parking lot. The market trend is unaccountable and we will not be in any complications whatsoever due to the outstanding high demands on the growth in the market trends on motor carriers and road services providers, that is needed. So I came up with the idea to do road repairs right on the spot, if it minor repairs, if not minor repairs well tow you from breakdown point to your personnel location regardless where, theyll tow you to garage ONLY. The payloads gross revenue ranges from $1000.00 to $7000.00 per payload per day, plus fuel cost, as well for all vehicles that this company provides.

Operations;

In the 1st 3 years we'll be operating as a small independent company we already have benefits, and our drivers is or will be qualified with all requirements. Ourway or No Highway Towing & Trucking Services office space in the beginning stages will operate out of an office facility by simple constructions sites trailer type building. Then eventually a larger building, zoning is a key factor, will be relocating out in Geneva, N.Y. to an empty lot, to rebuild a new facility. The type of equipment required is a simple refrigerator straight truck at (1st) first with the intentional price of the original loan, grants or finances provided. Then we will purchase more straight trucks, then once the straight trucks makes the loan, grants, then we will purchase (2) two tractor trucks, the same year.

The purchase of the tractor (trailer models) trucks is providing longer distances services, larger loads. Then in the meanwhile we will be purchasing used two (2) more vehicles to provide our road services, as we originally planned. Our towing services is not like the others, either rain, sleet, snow or shine, we will do the minor repairs, on the road, in which other towing companies will not make any attempts to do any repairs, whatsoever, they make their money towing you to the mechanic's garage.

Organization and Management;

The secretary will be running or managing Ourway Or No Highway Towing & Trucking office, her key job description will be as if as if she owned the company herself and she will be the receptionist, until we get larger in size by clients, and customers, then we'll be hiring a qualified secretary or send her to school. The transportation broker will be contracted to our company as he's needed, more fleet of commercial vehicles. My job description is, 1st of all I am the owner and will not be acting as an owner operator, I will do the job interviews, paperwork, and all necessary needs to keep my company up and running. There will not be any weakness in management whatsoever and as for incentive programs, bonuses, the only program we will have is employee of the month, recognition is better than any incentive programs, perhaps as the company gets larger.

Timing;

Our market strategies are to stay a float, and to stay as a personal base business, using the road services as a major part of our company. As our clients list grows we will be hiring new mechanics, our drivers will be coming from a credited school and pass a DNA drug tests to be hired with our company, people that had or have habits either stop showing up for work or some type of a mishaps, DNA drug test is a proven factor show how long ago the individual had any type of drugs. In our facility we will do oil changes, all tires repairs, lube jobs, tune up's nothing more.
