Complaint Review: Best Truss

Best Truss Fort Dallas Truss Miami Failed to read correction to engineering drawings provided to them. They delivered the incorrect trusses despite being told there was no bearing wall. They refused to correct their mistake and demanded we pay them for a second set of trusses. Miami Florida

I am a contractor.  Best Truss was contacted to bid on a truss job by one of my sub-contractors.  They told the sub-contractor that he had to sign something in order for them to provide a bid.  He signed their form.  Upon evaluting two bids, we awarded the job to a differenct bidder.  Best Truss informed us we were already under contract with them due to the form our sub-contractor signed.  I told them we had awarded the job to a different company and they threatened to sue even though they had not done any work yet.  It was actually a blank contract that my sub contractor had been fooled into signing.  When I discovered this, I decided it was not worth a fight so I called the second truss company to tell them what had happened.  They were fine canceling the order.

In any event, the property owner's architect had shown a bearing wall on the plan.  The bearing wall was revised to be a non-bearing wall.  This truss company was informed of this.  Despite this, Best Truss made a simple mistake and drew the plans expecting a bearing wall.  We caught this and sent their drawings back to them showing it was a non bearing wall. We followed up with phone calls and on site meetings.  

When we asked to speak with their CAD operator who makes the drawings, we were told that was not possible.  We were further informed that the company would communicate the information about the bearing wall issue.  We were further notified that the purpose of the drawings was so that we could markup and ducument the discrepancies.  Despite this, they still made and delivered the trusses for a bearing wall.  The staff and owner have dismissed theri error and informed us that we need to pay for the incorrect trusses in full, and pay for an entire new set of trusses.

I plan to buy the new trusses elsewhere and hope to get my money back without having to file suit.

First and foremost, we would not send out blank contracts, if a contract is blank, there is not contract. In addition, our company does not sue for signing a contract. If work is performed and no payments are made, the most we do is process a lien on the property.

In reference to the shop drawings, our engineers are always available for engineering support. If someone told you otherwise, we apologize and would love to resolve any engineering issues you may have.  

In regards to this particular case, we received other shop drawings that were approved as a bearing wall. Trusses were fabricated as they are approved. We do not fabricate anything without a signed approved shop drawing from the client.
