I purchased a Garmin 2620 GPS unit on 3/24/05 for my gf as a birthday present. The whole thing costed me around $1190 after tax. Because I already knew which model I wanted, so I just went in there, asked for the product, paid the price and walked out. The rep did asked me about the extended service plan which I declined.

Unfortunatelly, after I gave the present to my gf, she wants me to return the GPS unit because she thinks I should save the money for a house first. After about a week of discussion, I agreed with her and took my GPS unit back to Best Buy. However, the Car & Audio manager told me there is 15% restocking fee on the GPS unit. I told him I didn't see GPS included in their Restocking Fee Policy section. He circled that whole section on the back of the receipt and told me it's their INTERNAL policy that's not on their receipt or anywhere on the website...etc.

He agreed to me that it's wrong to have BestBuy not state properly on the disclosure, but he can't help me because it's an order passed down from their District Manager. After arguing for awhile, I see there is no way for them to give up that 15% restocking fee. So I took the unit back to see if I can find other method to get the full refund. I know there are many BestBuy current or ex employees on this website too. Do you guys have any suggestion on what should I do with this?

seems like the perfect case for small claims court.

Well, thats about $180. For some, its not a lot of money, but for me, well, I think its a rip off.

Return the unit, demand a full refund, they will refuse. KEEP ALL OF YOUR RECIEPTS. Sue them in small claims court. What have you got to lose? You're not going to get the money from them any other way.

This seems like the perfect case for small claims court.

Your GPS was a used item

Did you open the box or take off the plastic wrap?

The next line down from what you circled says there may be a fee for items not in "like new" condition.

The 15% sucks, but as a longtime retail employee I can tell you that most of the time customers will pick up the factory-packaged items over one that appears opened. Eventually it becomes the last one on the self, and customers will want a discount on it.

Keep in mind that as soon as you take an item out of the box, it becomes "used".
