On 10/18/15 I paid Better Living Credit Services $160 via paypal for credit repair and property listing for lease. The listings for property giving to me were from listings generally found on the internet, they were already leased (not available) and all managed by others.

On 11/18/15 not only my credit card with Capital One was charged $35 for the credit repair service but Better
Living Credit Services notified me that an owner for a property I was interested in wanted to current credit report and bank statements to verify income. (Now I have already given them my paystubs in Oct when I signedup for their services). I sent the documents but questioned why they needed the additional information, why they had not pulled my credit reports and it's been a month already and why they had not started on the credit repairs after 30 days. In the beginning I was emailing them back and forth about listings the manager was rude and disrespectful and did not want to assist me but she also refused to give me a refund. Therefore that's when she started to give me the bogus property listings. After I sent my bank statements and approval to pull
my credit report (2nd time) we had an exchange of wordsover the phone and she Seana Liberatore aka Seana Kov
ch said she was going to cancel my membership and not continue the process of my application with the owner of
property at 10655 Lemon Ave # 604, Rancho Cucamonga, CA 91737.

Convenient, right. So I asked for proof that she actually communicated with the owner and to show me she actually sent my bank statements to him. She refused and began to threaten me saying she was going to contact the police and Housing Authority. The website said 100% money back guarantee she is saying their policy is No Refunds. I just want my money back and ensure my information is not going to be used further in fraud/identity theft. On the BBB website (Better Business Bureau) there is another complaint very similar to mines. This is a pattern for this company. Complete Misleading Accustaions

Better Living & Credit Services is a property management and a credit repair service. We have been in business for over 5 years, and this is the most bizarre and misleading story that we have ever come across. I would like you all to please take the time to read the true story, and to prove to everyone that reads our rebuttal, I have attached proof that our rebuttal is true.

Shanita Daniel had signed up on our website as a credit repair member on a weekend (that is when our office is closed). The membership that she had purchased included credit repair and property management services, as it states on our website. I have copied and pasted from our website a description of what the “Single Credit Repair Membership” includes in which she had read when she had selected her membership:

“This service provides a copy of your credit report, Premium Membership, along with a guarantee of placement (some restrictions may apply) and credit repair. This is a 6-month service with an additional $35 a month (for 6 months).”

Premium Membership: Includes full access to Better Living & Credit Services updated website, personalized listings, applications, and you will have an assigned leasing agent. This service will last for a total of 75 days. No Refunds!

However, once Shanita had completed her membership on our website and had signed our credit repair contract and had completed all documents sent to her. I had come to realize that she was on a housing program called “Section 8” in which we normally do not assist with, since that is a government funding program. As she should have realized by viewing the properties that we have posted on our “Free Search Page” at that time.

However, even though she was on the Section 8 Program I would still go out of my way and contact all of our landlords regarding the properties that she was interested in and explain to them about the new Section 8 Program that she was on, and try to convenience them into accepting her application. Now we normally do not do this for our clients, but I did just to make her happy, and I had even explained that to her.

Now during the time, I was sending her Personalized Listings and speaking with the landlords on her behalf, and assisting her with the property management services that she had paid for. I had also sent her 3 letters that I had needed her to sign in order for us to receive her credit reports so that we can start repairing her credit. However, she had not signed her 3 letters within her 2-week time limit and instead she sends me 2 credit reports that were ran last May, in which I had never asked for. Now by her not returning the requested 3 letters to receive her credit reports; she had broken her credit repair contract with our company. In which it clearly states on page 1, B-4. In which I have highlighted for you to view.

Shanita had also voided her guarantee of us finding her a property to rent since we had found her a landlord that would accept her application and the Section 8 Program that she was on, and have her move into the property right away. Once she was notified of this she had rejected the offer. Now the property that we had her approved for was within her price range and was within the cities that she had wanted to live into.

However, when we find our clients properties that match their rental criteria and that they are approved for, we have done our part with our guarantee. Even though the guarantee has still been voided we still assist them in finding them a place to live, we just cannot guarantee them that we will be able to find them another landlord that will accept their applications. Our guarantee is good for one property not numerous properties for rent, as she was advised.

Now during all of this Shanita became very rude towards me and my staff. It was coming to much to bear with. She would first start calling my office and screaming at my customer service representatives on a daily basis. She would then start sending me emails with misleading and contradicting statements, and by doing that breaks her credit repair contract, in which you can find on page 1; B-3. In which I have highlighted for you.

One of her contradicting and misleading statements, in which there were many, in which you will see once you have read the email threads, was that she was being charged with fees that she did not know of. In which was not true, she was total advised in many ways by:

  1. Our website.
  2. The credit repair contract that she had signed.
  3. The recurring credit card form that she had personally filled out and signed.

Once she had sent me that email I had advised her on why the $35 payment was collected and what it was for. The $35 monthly credit repair fee is for our credit repair service and our property management service. As I was trying to explain this to her, she became very rude to me via emails, she would state that she was not “happy” with our services. I had then advised her that she can cancel her credit repair contract, so that she would not be charged for next month, and I would waive the cancellation fee on her behalf. She then refused to cancel her credit repair contract with us and still was sending me rude emails, while I was working on her application with another landlord that was reviewing her application as a prospect tenant.

During all of this, she became very irrational and would start emailing me numerous misleading accusations about our company’s procedures and I would keep going back and forth would her trying to explain everything to her, and she would still want to argue and be rude with everything that I would email her. At that point I, I had made the decision to call her. As soon as I had called her she immediately became very irrational and started to yell profanities towards me and use many racial slurs towards me as well. She had referred me to a “Mexican Border Hopper” and “Trash.” So at that point I had cancelled her credit repair contract immediately.

Overall, she had utilized all the services that she had paid for, such as:

  1. Full access to our property management website.
  2. Full access to our credit repair website.
  3. She had received Personalized Listings.
  4. She had received credit report letters to assist her in repairing her credit.
  5. She had been approved for a property to rent.
  6. Her credit repair audit (which is performed over the phone).

As proof of my statement, I have attached the following:

  1. Email threads going back and forth between the 2 of us.
  2. Emails sent to her with her Personalized Listings.
  3. Her signed credit repair contract.
  4. Her cancelation letter.
  5. Are “I agree to the terms and use” which shows are “No Refund Policy.”
  6. Cancellation Letter.
  7. Her voided guarantee letter.

After all of this she had decided to file a dispute with her bank to receive her money back. However, that had back fired on her after the banks had read and reviewed all of the proof that we had sent them, her bank to decided not to continue with the dispute, and returned the money back to our account.

After reading our statements, and her misleading story, you will come to realize that nothing in her story adds up. Not once have we stolen her identity, nor scammed her out of her money.
