FILED COMPLAINT UPON BIDZ.COM WITH CALIFORNIA ATTORNEY GENERAL FOR FAILURE TO DELIVER. PAID ON SEPT 2 06 VIA US POSTAL MONEY ORDER. SHIPPING RECORD SHOW THAT BIDZ.COM IDIOTS SHIPPED TO WRONG ADDRESS. WON'T REFUND. THEY WANT YOU TO JUMP THROUGH HOOPS TO RECOVER MONIES --SCREW THAT. I AM FILING A POSTAL FRAUD COMPLAINT AND ALSO WILL SUE THEM IN POMONA CALIFORNIA SUPERIOR COURT.

Ongoing reluctance to provide information to Bidz.com via this complain is only hindering our attempt at resolution.

1. Police report filed with Yucaipa, California Sheriff department.
2. Complaint filed with California Office of the Attorney General.
3. Postal Inspector complaint filed.
A refund was not requested. The demand is to deliver the merchandise as per the auction and as of October 7 (paid on October 9), the merchandise is approximately one month late (as of today, October 7). In that Bidz.com only began processing a refund AFTER A POLICE REPORT WAS FILED on October 6,(and a after a bidz claim form filed), this causes even greater suspciion. Why would they act only after filing a Police Report?
Fortunately, Bidz.com is in Los Angeles County, California, *and the Pomona Superior Court (*also Los Angeles County) are within reasonable driving distance.
ISSUES IN THIS MATTER:
A. FAILURE TO DELIVER THE MERCHANDISE.
B. BIDZ.COM BREECH OF CONTRACT VIA SENDING REFUND RATHER THAN THE MERCHANDISE.
C. WILL SEEK RECOVERY OF COSTS OF THE MONEY ORDER AND POSTAGE.
D. WILL SEEK COMPENSATORY DAMAGES UPON BIDZ.COM (TREBEL DAMAGES)
E. WILL SEEK AN ORDER FROM THE COURT REQUIRING BIDZ.COM TO DELIVER THE MERCHANDISE
In the event that Bidz.com does send a check, the check will be photocopied and the original then returned via Certified mail with a demand to deliver the merchandise.
Following this, if the merchandise is not delivered within 10 calendar days, a lawsuit will be filed in the Pomona California Superior Court, small claims division, demanding production and delivery of the merchandise.
Being that the same two item have been posted to bidz.com in subsequent auctions, there is NO EXCUSES AVAIABLE TO BIDZ.COM FOR NOT BEING ABLE TO DELIVER THE MERCHANDISE.
Being that Bidz.com shipped the merchandise to the wrong address (Bell, CA), this offers absolutely no excuse whatsoever for not making arrangements to have replacements shipped immediately to the correct address.
A REFUND IS NOT AN OPTION. BIDZ.COM IS UNDER CONTRACT TO DELIVER THE GOODS.
