Complaint Review: Bil Ray Aluminum Siding

Bil Ray Aluminum Siding ripped me off over $15,000 and the department of labor is investigating Rip-off Albany New York

I was one of the top salesman in the office and Bil Ray continuosly ripped me off of commissions. When I asked why, I was given several excuses like my calculations were off, I ordered the wrong materials, customers financing fell through, even though the job was complete, etc, etc. The people responsible are John Ryall, the office sales manager, and Tom Peterson, the v.p. of sales. I urge anyone who is thinking of working for them to do otherwise, they are cheats and every employee knows it. The shame of it is that they do most of Sears' home improvements.

If any more proof to the level of unethical practices were needed the fact that the employee "Nick" stated that they only do work in the NYC area is it.  I know exactly who Nick is.  He has been with the company since the days when Bil Ray represented Sears.  He knows fully that the company which now has shrunk down to only operated in the area that he stated used to do work in the upstate NY, Connecticut and New England markets.  He also knows that Tom Peterson worked for the same company....and yes, that guy was a crook.

They lost the Sears account years ago and started doing all the work for BJ's Wholesale Club.  However, due to poor management and obvious mishandling of finances the company has now started having BJ's stores taken away from them and they continue a hard downward spiral.  

While the salesman who posted this may have under estimated on a job and legitimately been cut in his commissions, there is no doubt that Bil Ray, now more than ever, is a company that will take money from it's employees if needed.  They have installers who are owed tremendous past due amounts for work performed and homeowners should realize that those installers can come back and place a mechanic's lien on their house if Bil Ray does not pay.  They also have salesman who are owed thousands of dollars.

When times were good, this company was a very good one to work with as there was tons of money going around.  When times got tough, the true colors of the company have come out.

We have no record of this employee working for us.  None of the people mentioned in his report work for the company.  He must be referring to a different Bil-Ray.  We service the entire New York City and Long Island area.  We are the exclusive contractor for BJ's Home Improvements and currently have no affiliation with Sears.

of earned commissions. Sears will do whatever it takes to make the most of each an every sale, whether they get it from the sales associates commission, the installer(s) or the customer. Sears should be brought down for the damage it does to its customers and employees. It is unreal the number of victims of Sears. Sears wrongs someone some how every single day. I hope that one day Sears will be under investigation by the Federal Government.

I filed a claim with the Dept. of Labor against Sears for commissions earned that they refuse to pay. Sear's filed a response to my claim and I submitted a reply. Long story short, The ODOL issued an Administrative Order of Determination in my favor ordering payment from Sears in an amount just over $12,000. Sears has, of course, appealed the states order. I anticipate they will drag this out for as long as possible, which is fine with me. The longer they refuse to pay me for earned income, the more they will owe. I have all the time in the world, a state issued order in my favor after a thorough review of the evidence, and legal representation provided to me by the ODOL's General Counsel's Office. I feel pretty good about it.

And they will use your commission to give customers an additional discounts. AKA as RE-HASH in the home-improvement sales business. If you leave the home without a sale they will typically give the customer an additional 20% off. If you lose a sale they will give the same discount before they allow it to cancel. NO! Cancel Save commissions any more. And if your about to get a bonus they will CUT you on a job so as not to be paid a bonus.

On the other hand you worked there, you know you worked there cause they kept you busy and you made money so you should just look at it as a cost of doing business. Much cheaper then quitting and looking for another job, isn't it?

Without knowing the details, but being a business owner for over 25 years, this so called "RIP-OFF" report sounds as though it's from a disgruntled employee. Let's all remember, that we are only reading ONE side of the story. As educated people, we all know that their are always two sides to every story. Do not lend any weight to this allegation.

I knew "John" personally and worked with him. Fortunately, Sears has dumped Bil-Ray and the office is no longer open. Unfortunately, several others of us are now in John's shoes and are not going to be paid commissions on our sales either. What a bunch of crooks the Bil-Ray Group turned out to be!!
