I went to Bill Heard Chevrolet and I purchased a used truck.

First of all they sold me the truck at the price of a new car. I am a bit ignorant and I did not know that I could purchase a new truck at that price.

Secondly, they asked me that I would need to give at least 10% down, which I gave $8,000. I bought the truck at a very high interest rate because I did not have any credit.

Three weeks later they called me and told me that the deal had fallen through and that I wasn't approved. They came to pick the truck up at my house and when I went to request my money back they told me that I was not entitled to it.

So I tell everyone my story of the horror that I went through and I have met people that have gone to bill heard and when they hear my story they don't go back even if they are approved.

Bill Heard tells People that they are approved but they will turn around and say that you were not approved and give you hell before they refund your money.

FYI, it has been 6 days since our dealership has posted a response to the alleged $8000.00 downpayment that we supposedly kept from Antonio from Austell. To date we have found no record of such a transaction, nor has anyone here received a response from Antonio. We suspect this could be an erroneous report that is an attempt to discredit our dealership. Antonio, if you are for real, please call us, we sincerely want to get to the bottom of this.

It is not now, nor has it ever been the policy of Bill Heard Chevrolet to keep customer down payments. We do engage in the practice of spot deliveries as do many other dealerships. In those instances the customer's money is receipted in and they sign a Bailment Agreement which states that the delivery is subject to lender approval and outlines the customer's responsibility to insure the vehicle, provide documentation required by the lender, and what fees and charges will be incurred if they abuse the vehicle while it is in their custody.



I agree with the statement that anybody can get approved if they have enough down payment. Getting that contract funded with the lender is another matter. Sometimes the customer cannot prove their income, residence, or employment ( a common problem with self-employed people who do not file taxes ). We may have secured an approval, but the customer cannot meet the requirements of the lender and must return the vehicle. In almost every case their full down payment is refunded! There are rare occurances where they may have damaged the vehicle and we will cover their deductible with a portion of their down payment. In the event that they do not have insurance ( some people will provide an insurance card but the policy has lapsed and we don't know it until we can contact the agent), then they are responsible for the total amount of damage incurred.

I have researched our records and we have no information concerning an Antonio from Austell, nor any record of an $8000.00 down payment. If he will contact me with the specifics of his claim I will be more than happy to help him if he was not treated in a fair and legal manner.

Your little threats and attempted intimidation of the person having the problem with your DISreputable company illustrate clearly the attitude the consumers who have posted reports have had to deal with. Thank you for being so helpful in making all of the DISsatisfied customers' complaints seem so much more valid.

Dear Rip-Off Report:



After reviewing the report dated 12/03/02, I felt compelled to respond to this absurd and totally untrue accusation against one of the most respectable and reputable dealerships in the country.



In the case of "Mr.Antonio from Austell", it is very hard for us, Bill Heard Chevrolet, to justify both legally and morally , not refunding $8,000 dollars of a down payment.

This claim is not only absurd but also false and malicious!!!!!



We at Bill Heard Chevrolet do not "cram old sleds" and we do not sell cars out of our "bone yard". WE PROVIDE CUSTOMERS WITH GREAT VALUE, SERVICE AND RESPECT.



We are in the repeat bussiness. To do what "Mr.Antonio from Austell " claims we are doing, is not only absurd,but a terrible bussiness decision.



I strongly reccomend "Mr.Antonio form Austell" to contact the Federal Trade Commission or his counsel with HARD EVIDENCE of our practices. I am quite sure that no attorney in this country will refuse this case, providing the legality of the claim.



On the other hand, our reputation is something that we don't take lightly and Mr. Heard will use any means necessary to make sure that false and malicious claims are dealt with severely and in a expedient matter.

Regardless of what Bill Heard is telling you, they HAVE to give you back any monies that you gave to them as a down payment for a vehicle if the deal went south.



I'm sure if you read the back of your contract it will say somewhere something to the effect of: If the deal is canceled by either party for any reason, all monies, itemes, or vehicles used for a down payment or collateral must be returned to the consumer within a timely manner. So, if they are refusing to give you your money back, you may want to contact an attorney. If you are telling the WHOLE story, which most people on this site don't, then you are entitled to the money back. Now, if you damaged the car or something then they may be entitled to some of the money.



Also, if you were a first time buyer and they could not get you financed on a USED vehicle with $8000.00 down, then something is really screwy with them anyway. If you have completely trashed credit with 6 repos you could get financed on a $10000.00 car with $8000.00 down!

Your Rip Off Report is the very reason I became THE GREAT THORN. It is High time car dealers stop RIPPING OFF CONSUMERS!



Antonio the reason I feel that this dealer is not giving you YOUR MONEY back yet, is because they might be trying to find a way to cram you into some old sled that they might have in the far back end of their BONE YARD. BOTTOM LINE is THIS DEALER WANTS YOUR MONEY no two ways about it.



They might just think that "Hey we have his down paymnet, So what is he going to do? Go somewhere else and buy a car, YEH RIGHT!



If the original car deal fell apart and they came and took the truck they should give you your $8,000 dollars back, in cash or in a check that is NOT MADE Of RUBBER.



First I would contact your state banking commission RIGHT AWAY as in "NOW" and tell them what this car dealer has done to you, and that they as of yet not returned your down payment back to you.

I Personally will call this dealer and ask a few questions.



If a car dealer can't get a car buyer a loan for any reason, they have to return YOUR DOWN PAYMENT back to you. They can't keep it.

also if this dealer trys to get you to come down to their car lot to sign some "NEW" papers for a Bank, I would not do it, I also would not let them come to your home and try to sweet talk you into signing a DAM THING at all.
