On Aug 6, 2009 I noticed several strange payments on my online bank statements. Using my home phone I called one of the numbers for ACBERRY (866-973-7865)which was listed on my bank statement. I was on hold for so long that I decided to use my cell phone to call another nother number for IRESV (Resveratrol 866-667-0877). Low and behold they were playing the same exact on-hold musak! I realized then that the companies were the same. After some digging I found that Biolabs is the owner, however, after calling up a company that used to represent biolabs, I was told that they had changed their names several times. One of the names the rep gave me Genesis Bioventures, Inc. I went to PRNNEWS and searched the name and found that it was changed to Abviva, Inc. This company is a scam and changes its name like some people change clothes--probably more often!

Trying to contact this company by phone leads to madness so I have faxed them and will continue to do so until I get a response. If they do not refund the money I will find their board members, associates, sponsors and whom ever else and I will call and fax until I get results. I suggest everyone that has been taken by this company do the same!

The only thing i did order was the 14-day trial for the RESVERATROL and the DEMAPRIL. I missed the trial cut off and was charged for both. When I went to cancel I found all kinds of crazy charges on my bank statement. In one day, Aug 5, 2009, I had charges of:

$83.18 for FATBURNER, which i did not order
$83.18 for ACBERRY3, which i did not order
$2.00 for a processing charge for eht ACBERRY3
$1.95 for a processing charge for the FATBURNER

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

BIOLABS Redemption - THEY REFUNDED ALL MY $$$$

On about September 2, 2009, Biolabs refunded all monies taken from my account. Was it difficult to get the refund? HELL Yes. However, I kept a dated and rolling account of every conversation I had with the company and my bank and anyone else I contacted. This included hold times and transfers to supervisors as well as all of their CSR operator number (i.e., Susan--S14). In addition, I filed a dispute with my bank and asked for the banking/routing information where the money was sent to. I'm with a small credit union and the security personnel (managers) contacted Biolabs and their associate organizations as well as provided me with paper-trail printouts of the transactions. They also gave me numbers for the VISA network because the money was drafted from my debit card. Additionally, I also filed online complaints with the Attorney General's consumer protection service. Moreover, I contacted Biolabs daily and scheduled faxes to be sent to them on the hour demanding my money back.

From my experience with this matter I would advise anyone doing trials online to BE EXTREMELY CAREFUL. Research the product ahead of time even if the endorsers are well-known. Document and date your transactions, for example:

0904/2009 - rec'd email stating 2nd and final refund had been issues to my account

090209 at 12:00 spoke with Jensai (S-225) who gave me a cancellation number: 1467289.

090209 at 12: 15: sent fax to confirm product return: 954-927-9978

0902/2009 11:46am spoke w/Rowena (A-283) who transferred me to supervisor Kizz (Sup-042)

0826/2009 at 8:10am spoke w/Ashley (A- 15) who transferred me to supervisor Maggie Cruz (S-39) who was put on the line @ 8:22 am and after I briefed her on the transaction of 8/21/2009, she put me on hold at 8:23am to check the status of my account. I gave her the following information about the return:

0824/2009: checked my account and 87.13 was credited to my account

082109 Spoke with James-S-18 at 8:20am (CST) put on hold while he supposedly reviews MY records. He informed me, after much debate, that Supposedly, $87.13 has been placed back into my account as of 082109. The other $87.13 will go back when the merchandise I just received--that I told them not to send--is returned: RMA # 146289 9481931 Return Dept #3007 Green St Hollywood Fl 33020

Print and COPY the terms and conditions and put them in/on a word file, disk, pen drive/ or notebook. NEVER admit to clinking on any pop ups. My standard line to any bank or service is that "I have Norton and it is set to deny popups."  AND If you do a trial offer, and then find money coming out of your account by companies you have never heard of, quickly have your bank put a stop on your debit card, (most of the debit cards embed your bank account number).  You don't have to close your account. If you have direct deposits and automatic withdrawals coming out of your account here is what you can do:

1.  put a POS stop on your debit card, but allow ATM withdrawals.

2.  Have your bank redirect your direct deposits to your savings account. Make sure that you have overdraft protection, which will automatically take money from the savings and cover any outstanding checks (it's a free service with he credit union).

3.  Provide the bank with a list of safe creditors (insurance, phone company, utilities company...) you'll allow continuing taking money from your debit card.

4.  REMEMBER that your money is insured and if you file a dispute YOUR BANK has a responsibility to investigate and cover the money. If they get no response from the creditor within 3-5 days, they have to automatically return your money up to a certain limit. Also, you can contact the FDIC or National Credit Union Insurance that covers your bank

NOTE: I would also recommend establishing a new account where you can transfer money from the old account to. This way you get a new debit card that scammers do not have a number for.
