Complaint Description - Posted 12-27-2005
Rod Thompson was salesperson from Blue Haven. Once he gets your signature on the contract, he's out of the picture. Contract signed on 7-23-05. He said no problem with excavation unless "the find a boulder the size of a car" Excavation performed in August, rocks left on property had to fight for weeks to get them removed and then only some were removed. They do not use any english speaking workers. They allow trash all over your yard and refuse to pick it up until they recieve final payment. They will not return any phone calls and when you do get through, they direct you to someone else who gives you the run around. Pool plastered in October 2005. Had to hire American Leak Detection because Blue Haven did not feel that losing an inch of water a day in the winter was due to a leak. American Leak Detection found 4 major leaks and 17 structual leaks. We have the profeesional opinion from 4 pool related employees/owners that the filtration system and pump are faulty. Placement of shutoff spritzer valves installed too close and will lead to failure of pipes, pool umbrella in contract never delivered with the other startup items in contract. We have called and sent certified letter but have gotten no reply.

Company's Response Initial Response - Posted 1-20-2006
As of this date Blue Haven has made arrangements for superintendent to meet with Home Owner on 01-23-06 and will deliver umbrella that is normally is picked up by Home Owner at time of tile selection, the other three issues will be assessed and taken care of accordingly in a timely manner. Blue Haven is sorry for any inconveniences Home Owner has occurred during the construction of their pool.

Consumer's Rebuttal Rebuttal - Posted 2-24-2006
Blue Haven set appointment for 1-23-06, we took time off work to meet with them, and they never showed up. Our lost wages and stress levels that they have caused are no concern to them. We were not given or told that we could pick up the umbrella at tile selection. Yet the start up crew said that the umbrellas were back orderd & would be delivered when in stock. Blue Haven has cleaned the coping & grout. No other issues have been addressed. American Leak Detection has sent Blue Haven a report indicating 4 major leaks, up to 17 structure leaks, and beleive that the pump/filtration system is faulty. Sergio and Emmanuel have been lying to us saying that evertything will be fixed. They contacted us on February 10th to arrange another appointment. We informed them that we had 2 deaths in the family and would contact them the following week to arrange another meeting. Obviously the office did not give this information to the supervisor because the supervisor shows up at our house anyways on 2-13-06 and calls our cell phone mad that we are not home. We were across country for the 2nd funeral. Blue Haven then sent out a supervisor on 2-23-06 who knew none of the issues, was adversarial, and did not address of repair any issues. He stated repeadetly that he was pissed off that he was at our house before hours. We just want them to fulfill the contract

Company's Final Response Final Response - Posted 2-27-2006 On 02-23-06 @ 6:45am Blue Havens superintendent Trini showed up for yet another scheduled appointment with the homeowner, the 12-13 05 appointment never transpired due to homeowner neglecting to say they would be out of town, as for the meeting on 02-23-06 homeowner was very angry when they answered the door, it appeared they had just woke up and was not planning to meet with Trini again so began yelling, screaming and not addressing the issues at hand. Trini had the umbrella in the truck to deliver but unfortunately homeowner kicked Trini off the job site before he could deliver it. Homeowner has be this way from the start of this project. Blue Haven would like to complete contract too.

Customer rebuttal 3-22-2006
The 12-13-05 appointment that they are refferring to above I assume is the 2-13-06, once again Blue Haven shows how professional they are. We clearly told them that we would be out of town and why. My father in law and grandmother passed away in the same week and Blue haven has the audacity to be rude to us due to their poor communication skills. My husband wasn't happy to see the supervisor the morning of 2-23-06 because we have been given empty promises for 6 months now. We new he was coming and we expected him at 6:30am not 6:45, we figured he was no show yet again. We never yelled or screamed at Trini, but he claimed to know none of the issues. How is that possible and why would you come out to a job not knowing what the problem is? We did not throw him of the site, but did ask him to leave since he said he knew nothing and that he just kept repeating that he was pissed for having to be there so early. He never attempted to deliver the umbrella.

We contacted the BBB to asks them to remove the slander or allows us a rebuttal regarding Blue Havens blatant lies and portrayal of us, but they refused. Saying we would have to put it in a lawsuit. Contractors State License Board is getting so many complaints, they are trying to revoke their license. The information that they have you sign regarding their insurance is not correct. Their general liability insurance company is Hartford/ Speigler Insurance Services 858-459-8834. They have to have a cash bond with the State License Board due to their bad work. The plastere hat they used for our pool is Jeff Kerber Plasters, they are responsible for the leaks.

We have paid $36,000 for a pool that leaks and has bad equipment. They will not plaster the pool unless you give tham payment in full. We have not been able to enjoy our pool. The water bills for a pool that leaks an inch a day should be Blue avens problem not ours. We can't heat the pool to enjoy it because it is not cost effective with it leaking so badly. We installed this pool so our son could enjoy it and because my husbands bad back. He has not got to use it for this purpose and this ordeal has incresed his blood pressure. Their contract states that every pool that they install will hold water - ours does not, and that the equipment is free from defects. They are trying to eat up time in their one year warranty so they can hit us with the charge for new equipment. If asking them to perform to there contract is being difficult, then yes we are guilty of that. But that gives them no right to slander and lie about us online and perform contract fraud. We just want the items repaired and at this point by anyone but Blue Haven. I do not trust them anywhere near my property, family, or self.

Class action, picketing, what type of lawyer, any suggestions? The BBB ad CSLB has onlygotten us so far.

Par Pools IS NOT associated with Blue Haven Pools

#2REBUTTAL Owner of company

Mon, July 31, 2006

I don't know why my company's name is listed in this "rip off" report. My company, Par Pools.com, Par Pool & Spa is located in Stratford, CT and doesn't even do concrete pool construction.

Our company's name should be completely removed from the report as we had NOTHING to do with the installation.

For further information, I can be reached at Par Pool & Spa, 203-377-0100.
