Blue Haven Pools
Blue Haven Pools out of Garland/Dallas Texas built my pool back in 2000. You would think for $30k you would end up with a product that would last and a product you would be proud of......I guess not in this case. If you are thinking about building a pool please read on as this could save you valuable time, money, and frustration.
My yard had a slight grade to it, roughly a couple of feet back to front. Blue Haven solved this problem by implementing a retaining wall. The retaining wall and pool design were done by two less than competent individuals that I don't believe had one structural engineering degree between them. The wall was to be 18" high. When it was all said and done the wall was/is 3-4' high and would require much more stone than the original design, which I had to pay for of course. This is where the problems start.
Over the next year I quickly starting seeing the gap between the decking and the retaining wall get larger and larger; so large in fact that the mastic would not hold such a large gap. I had to call day after day after day and be a real *** to get Blue Haven to come out and take a look and do anything. There solution was to add another top row of stone with a slight overlap to help cover the gap but not address the real issue. That also in time failed as the gap widened again. Now pool water and rain would begin to poor in through these large crevices and eventually start to erode the substructure of dirt/sand.
After numerous calls and complaints I was pretty much told by Blue Haven that they don't warranty retaining walls, even this one which ended up being over two times the height of the original design. Get this; my city inspection office did not even pass their final pool inspection. Funny, the deck and retaining wall was what was red-tagged! Basically Blue Haven has told me that as long as the pool was holding water, they were good. Now my pool deck has collapsed in numerous points, the gap is wider than ever, and now, big surprise, the pool has incurred several cracks and the pool is leaking water. In addition the plumbing must be screwed up as a result of this shifting as there are leaks everywhere and the pump won't even prime.
The pool is just 5 years old and I paid these unethical idiots $30k for it. It is an eyesore and now I have a huge concern as to where all the water is going. Will it ultimately affect my houses foundation and or my neighbor's foundation and or pool, which was built correctly by the way, retaining wall separate from the pool.
As I prepare for one last attempt to get this company to remedy their product and possibly prepare for litigious events I wanted to share my nightmare with you so you can start your pool decision making process by NOT SELECTING BLUE HAVEN. I don't care how attractive they make it look. I don't care how much they come down in price. Do not use BLUE HAVEN POOLS or you will be sorry.

So I issued a reply to Blue Haven over a week ago stating that their offer is not acceptable and that I expect them to cover the bulk of the repair costs. I also explained that short of that I would continue on with additional pictures of the failed inspection red-tags I still have showing the retaining wall was always an issue. I also explained that I would take this up with Rockwall county building inspection and city manager to see what kind of impedence could be put in place for any further Blue Haven development in Rockwall county. Still waiting on their reply before I proceed. I'm sure Blue Haven doesn't think so but I'm trying to be somewhat fair here.

So I received my "estimate" in the mail today and I was correct. I am expected to cover 65% of the cost. Two things come to mind here.......one, this is not at all acceptable and two, even if I wanted this deal how do I know their 35% is not covered in the 65% I'm having to cover? How do I know the quote isn't inflated? I guess I'll bring in another builder, (I'll name names later) to give me their opinion and cost for reparing this disaster. Then we can see how this offer, regardless if I'm paying or not, stacks up.
Also, if I were going to throw more money at this mistake why wouldn't I hire a recommended structural engineer and pool builder vs. throw more money Blue Haven's way?
I'll mull this over a bit before issuing my next update and response.........

Writing to say I was surprised and impressed that the current management came out as promised and took a look at the situation. Now while we are far from an outcome at this point I was encouraged that they took the time and effort to thoroughly look over the retaining wall and deck and discuss possible options. Waiting on their response as to what these are and who will ultimately be paying for them.

So I received my written report follow up from the pool repair. Bottom line it says that they have no culpability with regards to failing retaining walls and or decking due to the age of my pool. This is a joke as I have been battling these clowns ever since my pool was just 9 months old. In addition the design called for a retaining wall that was only to be 18" high vs. the 4' high one I have now. And the insult to injury is that my pool never passed final city inspection. The deck and retaining wall were red-tagged three times. But that didn't stop Blue Haven from taking my money. They will, out of the goodness of their heart, send someone out to give me an estimate of what it will cost to fix everything. Like I would throw more money at this unethical entity.
So next I hire an attorney and start breaking down Texas Property Code, my documentation, city records, and avenues of recourse. I'm a reasonable person but this pool construction was a mistake from design to completion and I want Blue Haven to admit to the poor quality, my attempts to remedy all along the way, and make a reasonable effort to correct it.
What has happened here is wrong and I will explore every legal and political avenue possible as well as every consumer advocacy vehicle to ensure that regardless of my outcome other pool buyers have plenty of data they can find on Blue Haven which will make them think twice about their purchase. The cost of the bad press and foregone future sales will I'm sure far outway the cost to remedy this disaster. It's all I can do as a consumer.

So The Crack Dr. showed up today and indeed confirmed the leak and it was pretty significant. I did not know they were going to do this but they patched up all three cracks, all of which were long. This has seemingly stopped the leaks but for how long. It is a temporary solution as even they agreed that the retaining wall movement and deck heaving would eventually create the way for possible more movement and cracking. Bottom line, the root cause, I feel, is that the pool is still not sound and because of the sinking/heaving deck will at some point be unsafe to use. I am eagerly awaiting a call from the Regional Manager's follow up call to this report to see where we go from here or if that's it. History tells me that once again I will have to initate the dialogue.

I placed a call to the new manager over the Garland/Rockwall area today and while proof will be in the pudding at least he heard me out and agreed to send out some specialists to check on the leak and structural integrity of the pool. We'll see where we go from here...........
