My pool was built three years ago and just recently has it been noted that my heater was not placed within code. The code states that it has to be 5ft from any window. It was sitting at only 2 feet away, they have now moved my heater but refuse to move the rest of the equipment with it.

I now have a pump sitting in one space and 4 to 5 feet away, I have my heater. That means that I also have 4 to 5 feet of water pipe running from one piece of equipment to another. The look is terrible and not to mention what it has done to the over all value of the property. They can not honestly tell me either what will happen to that pipe in the next 5 to 10 years, or what kind of problems I will have.

I have already had more than my share of issues with the equipment, the decking and the entire pool in general.

I also based decisions of a sitting area due to the fact that the equipment would not interfere with this area. Well now it does because the heater is sitting two feet past the end of the house, right next to my sitting area.

Blue Haven claims their only responsibility was to move the heater so that it is now in code. But why was it not placed correctly at the time of construction? How did they get past all of the inspectors?

I now want them to place "all" of the equipment exactly as it should have been done at the time of the original construction. I have the original blue prints that show where and how the equipment was placed. I do not believe I am asking for too much.

I have called the General Manager on three different occassions and as of today I have faxed a letter to his attention. As of this writing I have not received a response. My next step is an attorney and to contact the Better Business Bureau.

Type or write your specific issues and send certifed mail return/receipt to the local office and individuals with names of the corporate entities you find (include P&A Holdings, Inc-TX, Blue Haven Pools National, Inc-TX, Z&E Management, Inc - CA which is corporate address in SD, CA, Golden State Industries, Inc. in NV and CA, to the troubleshooter Kyle Peek in the Southlake,Lewisville and all metroplex offices, to the corporate office at 636 Broadway, Ste 310 in San Diego, CA 92101 to all officers and directors listed on the Sec. of State list in TX (you'll find they are all from San Diego, CA and 1 minority owner in West Covina, CA.who you'll find online under Golden State Industries, Inc. CA. 51% owner is Alvin G. Eisman and people on the corporation in your area (Blue Haven Pools National Inc and P&A Holdings, Inc are all CA residents and work in CA--officers are just employees in the San Diego corporate office, but must be named in addition to corporate names. Don't forget to check your local city/county permit department records and for other local entity names the company is using; that are NOT with the state of TX.

2.Respond to all reports you see in TX and get together as a group to divide up research on corporation information you will need.

3.File report online with Attorney General; keeping all information factual and provide evidence; including your blueprint that the company rep drafted, your contract and any affidavits/declarations of witnesses to verbal agreements not included in your contract.

4.Check the city permit department personally to see why the inspector passed equipment not adhering to code. Maybe he only went by the blueprint? Then, you have 2 actions; depending on laws in TX.

5.Numbers of people in an area are power. You may want to get others to go in with you to hire 1 attorney specialized in class actions in construction and contracts.

6.Filing reports with the D.A. require proof, which it appears you have. You need to know that most DA's only act if damages hit around a million dollars; which is why others are needed, as well.

7.These steps are quick since you obviously have access to the Internet and can do most correspondence online. See if the Editor will put all Texas consumers together--giving you access to each other to proceed. You all have no other choice in a state that bends toward the business VS the consumer.

8.Get other people in the metroplex or throughout the state to agree to call the major consumer reporters for each station in TX and see if 1 or more will do a mass story for all of TX---This can be done by area, as well.

9.Call or write the newspapers in the metroplex, too. Editorials are very powerful and how nice if everyone would write in.

If you just say it's too much time or let them bully you, your dignity and pocket book are the losers when it should be the company owners and officers!

10.File small claims action individually and get others in your area to do same on only items/issues that will cause them to appear and issues that are valid such as destruction of plants and trees, clean-up, etc.

11. The BBB will act if they get enough complaints on the same company even though the company pays for membership. If no responses from company, the BBB should kick them out.
