PLEASE SCROLL TO BOTTOM FOR Helpful #'s & Websites

I am unable to get an explanation for the fees from my Loan Servicer Loan Servicing Group, LLC formerly Blue View Corp.. My Principal Balance is $6.88 & Interest is $.004 on 10/8/07, but they are trying to charge me $175.00 in "Other Fees", On 10/8/07 my Payoff Letter stated $175.00 in other Fees, I have written them several times asking them to disclose what these "Other Fees" are so on 12/14/07 they raised the "Other Fees" to $252.00, on 1/3/08 they raised the "Other Fees" to $265.00, THEY WILL NOT DISCLOSE TO ME WHAT THESE OTHER FEES ARE EVEN THOUGH I HAVE REPEATEFLY ASKED FOR THEM IN WRITING TO DO SO. Since I do not want to pay these other fees I sent them a check # 2370 in the amount of $17.00 via Certified mail which they received on 12/20/07, I figured this would pay the PRINCIPAL & INTEREST balance of my Loan & leave a little extra in my escrow account, THEY SENT IT BACK, I thought OK as I had received a borrowers late notice of $11.97, so I mailed them my check # 2640 in the amount of $11.97,they receved it via Certified Mail on 1/2/08, they wrote VOID across it even though it was attached to there borrowers late notice. My last Payment statement I received stated my Ending Principal Balance was $6.88, however the amount due they requsted was $210.00, HOW CAN THAT BE if my Principal Balance was $6.88. It appears no one at this place of business can adequately explain what these other fees are. First I was told it was for the release of mortgage (Not to include Recordation & Cancellation of same.)

I have also been told that they will cancel the mortgage. I have also been told it was a reconveyance Fee. (Louisiana is not a Deed in Lieu State and there would not be a reconveyance of property. I have been told these fees are for recordation of assignments not associated with the loan closing. I do not believe the consumer pays for assignments not included at time of closing. And Finally I just want them to put the fees they are trying to charge me in writing so I may dispute them and have them as evidence if necessary. THEY HAVE REFUSED TO LET ME TALK TO THE LEGAL DEPT.I WAS TOLD ON 2 OCCASIONS THEY WERE NOT GOING TO BOTHER THEM WITH ME AND THEN HUNG UP ON EACH OCCASION. I HAVE ASKED THEM TO PROVIDE ME WITH THEYRE REGULATORY AGENCY AND HAVE BEEN REFUSED. I HAVE ASKED FOR WEBSITE: REFUSED, ETC, ETC. Can this Company Blackmail me in this way. I again have attempted to PAY my P & I so the account was not delinquent and they have on Both Occassions sent it back. I think they just want to take my house. Can you please review PDF attachments and advise me, Sincerly. See Attached Correspondence

RE: LOAN # XXXXXXXX

Dear Sir or Madam,

This is in response to you payoff statement dated October 8th, 07, Regarding LOAN # 04P8830BVI,
I am attaching Copy of Your Payoff Letter,

CAN YOU TELL ME WHAT THIS $175.00 OTHER FEES IS.
Other fees is a vague term that does nothing to explain this charge.

I had already attached the completed forms for Cancellation of this mortgage for your convenience and your representative needed only to sign them, additionally I would prefer to file them myself as I wish to obtain a certificate of cancellation for my file and if I file them myself I will be able to obtain same in a timely manner.

Please note your assignments did not have the correct recording information on them you referred to Document No 05561 in book 584334, page 006, the Correct recordation information is Instrument # 99-05561, MOB 3887, Folio 249, this correct information was listed on the cancellation request I sent to you and of course on the copies of the mortgage and assignment I also provided.

Additionally the Clerks Fees for the Cancellation with a certificate of Cancellation is $16.00 & without a certificate of Cancellation is $10.00. I sent you a copy of the clerks fees along with completed forms, copies of subject mortgage and assignments of same.

RE: LOAN # XXXXXXXX

Dear Sir or Madam,
You have sent me a Borrower Late Notice, however, I have been trying to pay this loan off Since 10/3/07.

I am writing regarding my mortgage account # 04P8830BVI, . In October I requested a payoff statement from your company. I received the statement dated 10/8/07 and my P & I due was $6.88 but there was a charge for $175.00 called "other fees". I called and spoke to Summer ( I assume this is the same Summer Lee Caslin, Notary ID # 1510749, Commissioned in the County of San Diego that appears on Assignment @ MB 4341, Folio 133), and asked for a written disclosure of what these fees were for (I have never received it). I was told they could not give a written disclosure. Summer also stated she did not know what the fees were for. Next Summer stated it was only for the preparation of the cancellation but they would not actually have it cancelled. I advised that I had already prepared the cancellation and since I do this for a living I know the cost is $10.00 without a certificate of cancellation and $12.00 for a certificate of cancellation. Also the information you provided regarding my mortgage was incorrect the recordation information for the Assignment was not the right MOB and folio. The cancellation I provided is the official form used by Jefferson Parish Mortgage Office and I had completed it with the correct MOB and folio.

Next I was told it was a reconveyance fee I advised that Louisiana is not a deed in lieu state so there was no reconveyance.

I was then told it was for the cost of assignments. I stated that closing costs can not be added on after the fact and without disclosure. Working for Countrywide I know mortgages are assigned all the time but the costs incurred are absorbed by the buyers and sellers of the paper not the borrower. Money is made in servicing these loans and the costs for assignments is a cost of doing business.

I asked Summer if I could speak to the payoff department or their legal department. Summer said and I quote" I am not wasting my legal departments time with your question". Following that Summer hung up on me.

I called back and asked to speak to the manager or legal department and Ms. Summer answered again and she said and I quote " Didn't I tell you yesterday that I was not wasting my legal departments time". Summer also stated she was the manager and said she would transfer me to an accounting voice mail "ok". I stated this was not ok that I would like to speak to a manager. I also asked who their regulatory agency was and was told they did not know but I could find it on their website. I asked for the website address and was told they did not know it. Summer again hung up on me.

I then looked your Company up in the California Secretary of States Office (And the Delaware Secretary of States Office as you are a Delaware Corp.) up and found that Carol Carpenter was listed as Loan Servicing Groups "agent". I then crossed checked and found a listing for Carol and left a message at what I believe may have been a home phone. I called back again and asked to speak to Carol this time and was told she was not there. I then asked for Carol's e mail address and was told they did not know it. I did receive a call from Carol and I advised her as to what was going, she and Stephanie I must say were very polite , although they could not answer my questions. I would advise them to state that although they do not know the answer they will find out the answer and get back to me or put the customer in touch with the person who can answer the question.

I have been in the mortgage business for over 15 years managing both the closing department and the underwriting department handling both Closing and Post Closing, in addition to having worked for a Title Company, being a notarial secretary, abstractor and a Notary Public.

I was appalled that customers would be treated this way. In addition Summer is a poor representation for your company In addition to not knowing the answers to simple questions regarding fees, she is rude, unprofessional and makes your company look like some crack pot operation with no professionalism or simple knowledge required in this line of business.

As a manager I would have fired her and I believe her attitude is not even worthy for a counter person at the local McDonalds. I believe even McDonalds has a policy regarding customer service and professionalism. I can assure you I never once raised my voice I called for a simple disclosure of fees. I know the typical cancellation fee when paying off a loan is $30.00 not $175.00. I also know there are laws regarding disclosure. I am trying to pay off my $6.88 mortgage and want a written disclosure regarding the $175.00. At this point It is the principal and again the poor attitude and ignorance of the law. Loan servicing Group appears to be blackmailing me. The attitude seems to be you are going to pay it because I said so and I have no obligation to tell you what it is for and matter of fact you are a nuisance and I cant answer your legitimate questions nor address your concerns.

It appears I will have to Contact OFI to lodge a complaint and any and all organizations regulates companies like yours all for a simple disclosure of fees.

So at this point I am enclosing a check for $11.97 I hope this is the amount to Payoff This Loan, Additionally This is my Second Request for a Payoff with the discosure of actual costs and fees Please Do not send me something with Other Fees as that is not acceptable and is to vague.

Thank you in advance for your prompt attention.

Sincerely,
