I am a victim of false, misleading and deceiving marketing, declared illegal under the Federal Trade Commission Act.
I found the website Department store liquidations . com aka BN Bargains, LLC very appealing at first, offering great returns and profitability. The Merchant offered on his website "BRAND NEW, NEVER OPENED, BRAND NAMES TOYS" 'HUGE VARIETY OF BRANDS AND CURRENT TOYS FOR ALL AGES."
ALL CURRENT ITEMS!!
"OVER $7,500-$8,000 Original Retail Value!"
Who could resist to that offer, it sounds great, the Merchant offered 450-500 brand new, current toys for $2,650, which is what I paid for the lot.
So, if the Merchant shipped 450 units, in order to reach $8,000 on sales every unit have to sell for $18, plus $5 for shipping, however, it would be not only impossible but immoral and unethical to sell the merchandise at that price. The Merchant sent low-value items and, some of them are cheaper in Walmart, Target, and Five Below, there, I found the same or similar toys for $6 apiece and other for less.
Merchant sent dollar store merchandise, outdated toys, stickers, pencils, old English books, cars that cost a $1.5 apiece in Walmart. That is why, it is insane when he claims the retail value is over $7,500-$8,000, so, I was cheated, I am another victim of an unethical merchant claiming he is in the business for more than 15 years.
Listen how the Merchant operates: after enticing customers first with false, misleading and deceiving advertisement, the manager Isaac continues making promises about the quality of his products and how other people are making money selling them. So, I was enchanted, it really sounds good to make almost 200% profit and, I made the purchase online with my credit card. After the Merchant has the money, hours after, he sent by email a new set of documents with new CONDITIONS OF PURCHASE, the language says: "THIS AGREEMENT SUPERSEDES ANY PRYOR WRITTEN OR ORAL AGREEMENT BETWEEN THE PARTIES" and continue renouncing and making void and null all the representations made on his website, verbally and by email. You could ask; why did you sign? I signed because I believed in the good faith of people and I lost.
I have decided to fight until the end, Discover, my credit card has made a decision-based in the contract. Discover do not understand that the contract presented by the Merchant could be null because is against public policy and unconscionable, meaning it is very unfair against the customer. In addition to that fact, the Federal Trade Commission Act, and state laws punish false, misleading and deceiving advertisement being this one a strong case as you can see on the pictures attached.
If you are a victim checking on FTC . GOV might help, you can file a federal complaint there and they are fair when investigating.
That is my story, there is always a first time, now my crusade is to advise other people about unethical merchants.

BN Bargains, Never formally offeref a refund, and they shipped their low quality merchandise after I cancelled my order.

Dear Consumer,
Be aware of this company, do not believe what they represented on its website, the merchandise they offered will not be the one they would ship to you. As soon as you provide them your payment information, BN Bargains will email to you a "conditions of merchandise/warranties" in which they renounce to any "prior written or oral agreement between the parties." They do not warranty the quality and price of the goods you purchase. I am still dealing with them, and I would file a complaint with the Federal Trade Commission, this company can't be in business. Please check other complaints in the Better Business Bureau, all of them related to the quality of goods.

Dear Sir or Madam,
Firs at all, my credit card company opened a second investigation and the chargeback has been granted to me. I have, however, forwarded to them what BN Bargains LLC wrote as an affirmation here, which is not true at all. The Better Business Bureau closed the complaint because we did not reach an agreement, they just follow they own rules. The last proposal BN Bargains LLC did with Better Business Bureau reads as follows:
"Our final order is to send back the complete order at your own expense as you originally offered.Upon receipt and inspection of the goods, we will issue you a full refund minus the 25% cancellation fee. Which will be $1987.50. This refund will only be authorized, if all future lawsuits, complaints, reviews, will be dropped. A document acknowledging this agreement will be prepared by us and signed by both parties."
As you can read it is not a full refund whatsoever, BN Bargains LLC, still will charge me for shipping and a "cancellation" fee of a merchandise that won't sell for "OVER $7,500-8,000." I asked them not to ship, but BN Bargains LLC, shipped anyway and left/abandon the boxes on my porch, so in order not to be fine by the city and receive complaints from the neighbors I storage the boxes. I asked BN to retrieve the boxes ASAP or I would charge them storage, but they choose to lie to my credit card company and not accept the return. Finally, and because the affirmations and evidence presented by BN, the truth has come out, and they want an "agreement." I asked BN for an itemized list of the merchandise they sent, so I would share with anyone what they sold, but they told the credit card company that they don't keep an itemized list of shipping, which does not make sense.
By the way, BN asked me for a photocopy of my Driver License and Credit Card, which might be illegal in the state of New York, and BN has released that private information to other parties without my authorization. I will keep on fighting for my rights as a consumer against unethical merchants. And if you are affected please visit www.FTC.org and filed complaints.
I reaffirm the false, misleading and deceptive advertising practices of BN Bargains,LLC/ www.Departmentstoreliquidations.com uses and also reaffirm I am a victim of them. They must make corrections in their business practice immediately.

This customer i beleive was confused upon ordering. It seems that he would rather smear our good name and reputation than to try to resolve this matter.
His credit card company agreed with us, as well as the Better Business Bureau who closed his complaint because of how unreasonable this customer is.
We offered the customer a full refund if he shipped back the order and he refused this option, which tells us clearly that he sold the products successfully and is trying to extort us for more money. We sell about 200 pallets a month, and over 50 truckloads. With the amount of volume that we do, we would never jeopridize that success with a $2650 order and have our reputation ruined. We have a 5 Star Rating with LiquidationReviews.com as well as many nice reviews on the Better business Bureau Website. We sell a ton of these toys pallets and we have many happy customers.
this customer is simply on a dishonest mission to ruin us. This ripoffrepot review is permanent and will be here forever. As a small business who offered this customer a refund, it doesnt seem fair.
