This complaint references and earlier complaint (333271) on Toyota Sales Corporation where they refused to repurchase a leaking, front end shaking, rattling 2007 Toyota Solara. We recognize that the warranty is by the manufacturer. However, the dealership should also be accountable as they actually made the sale and collected the money from the customer.

I purchased a 2007 Toyota Solara Convertible that leaks, rattles and shakes. Toyota and local members of the service department has admitted that they are unable to repair the vehicle. Numerous representatives of Bohn Brothers Toyota have tried to convince me that the problems are normal and acceptable. However, any reasonable person knows that a new car leaking is not normal or acceptable. Leaks can lead to mold or even startle a driver into an accident.

Page 316 of the owners manual states:
Convertible-Spray water on the side windows or top seals from above, at a 45 degree angle to the ground. It further states, Convertible-Do not spray water at side windows and top seals in a way which may cause water to enter a vehicle.

Obviously, no one can ensure that rain comes down or is blown at a 45 degree angle. Since this is in the owners manual and the service manager has stated that not only his 2006 Solara leaks, but they all leak. The dealership was apparently aware of the leaking problem. As such, they should also be held accountable. By definition, intentional concealment of a products defects is fraud by misrepresentation.

All consumers should be aware of the problems I have experienced. The dealership hides behind the fact that the manufacturer is responsible for the warranty. However, if the dealer had not sold a vehicle with known problems, I would not have the problem. Page 316 of the owners manual shows that they either knew or should have known the problems existed. Since numerous personnel tried to convince me that a leaking vehicle is acceptable, this supports possible fraud on their part.

Since Toyota is a large corporation and stands as a giant when challenged by separate owners, all potential purchasers of Toyota should consider Honda or other brands until Toyota does right by the owners of Convertible Solaras. In particular, potential buyers in the New Orleans area should refrain from purchasing vehicles from Bohn Brothers Toyota in Harvey. They sold the vehicle. Bohn Brothers Toyota should have the clout to force Toyota Sales to repurchase the vehicle without the consumer having to go through a lawsuit. Failure to do that in my opinion shows that they do not stand behind their sales as one would expect.

I currently own three Toyotas. I have a Sequoia, a 2007 Camry LE and the 2007 Solar Convertible SLE. All three of these vehicles were purchased from Bohn Brothers Toyota. Obviously, I am a very good customer and I have to file a lawsuit for resolution. How will they treat you if you have a problem and only purchased one vehicle from them? Would you make such a large purchase from a dealership that does not stand behind the sale?
