OK, I have recieved a letter from these people stating that I owe money to the TIDAL EMERGENCY PHYSICIAN for an ER visit for a day that I was in a serious car crash that took place in 2002.

I contacted a lawyer after this because the accident was not my fault.

As far as I know all my bill's were paid when I recieved my settlement. Now today I decided to call this Boyajian Law Office and I asked what the bill was for. He named off the hospital I was at AND the last four digits of my social security number!!

I lied and said I was never at that ER that day because I've been reading up on this man and he seems like a complete and total FRAUD!

Now, what I want to know is if he is licensed to collect my debt? In my letter it states that he purchased my debt from the hospital I was at the night of my accident. I know he is not a licensed lawyer ( except for California ) but is he licensed to collect debt's? I would love for my question's to be answered by anyone who may know about this guy.

Jenna,
Get a copy of your credit report and see whats on there. If you dont see it on your credit report (if its truly a delinquent bill) it should sit on your report for 7 years. If you dont see anything, see this office a nice cease and desist letter.
Lauri is wrong. You shouldnt have to jump through hoops just because a collection agency calls, the burden of proof lies with them not you.

They now have legal recourse against you

Jenna,

If as you claim all the medical bills were paid per the settlement, why not just get proof of payment, and submit it to this agency, as well as the 3 major credit bureaus?

Because you admitted you lied in a public forum, the agency can now (if per the contract they hold allows for it) take legal action against you UNLESS you provide proof of payment.

Just because the person you talked to is only licensed in California, doesn't mean they don't have reciprocal agreements with attorney's in other states to persue legal action if the debt isn't paid.
