I signed a lease agreement for the home owned by Brantley and Benita Floyd. Per the lease agreement the property would be move in ready on August 30th for the start of my lease. I had paid $850 for first months rent with security being paid in installments.
On August 30th the home was not ready to be moved in due to lack of cleaning and no transfer of house keys was done, but we had agreed with Brantley and Benita Floyd to aid with the cleaning with the understanding of waving the security deposit. As the cleaning began and moved along, mice traps were discovered along with large holes under sinks filled with foam expanding glue.
The cleaning was becoming overwhelming to me and the mice situation caused me great concern with 3 young daughters. Brantley Floyd asked me if I wanted out of my lease because of all the issue with sanitation and mice, due to the fact we never received keys to the property and didn't take possession of the property, I stated yes.
At this time he stated I defaulted on the lease and also abandoned the property therefore he didn't owe me any money and he was keeping my $850.
