On 10/21/11, Karen Lyons Pyle with Breard Law Firm, LTD sent me two sets of legal documents to serve.  Service was completed personally to the defendant on 10/24/12.  Proofs of service were mailed to Breard Law Firm, LTD on 10/27/12.  I have called, emailed, faxed and regular mailed bills since this time.  I am told that "their client hasn't paid them" therefore they refuse to pay the bill even though I was hired by this law firm.  I would not suggest doing any work for Breard Law Firm, LTD unless you are prepaid.

MY RESPONSE: As an employee of Breard Law Firm, one of my duties was to contact process servers and to get the documents to them needed for service of process, as I did in this matter; accounts payable were never a part of my duties and I had no access to the operating funds to meet payables.  I was responsible for accounts recievable, under the direction and oversight of Mr. Breard - I had absolutely no access to the funds disbursed in the accounts payable operating fund or trust account. 

Mr. Breard had complete access and control of the accounts payable - I had zero responsibility or access to pay any disbursements of the law firm.  With regard to this matter, I fulfilled my duties to the Mr. Breard's law firm as well to Mr. K**** completely.  As for the client, since I well remember the monthly billing to that particular client, I dispute the client's claim that they had not been informed of that billing.

During my tenure in that law firm, Mr. Breard was very diligent about making sure all billing that went out was approved by him, and he made sure that nothing, no reimbursable expense or direct expense was overlooked.  Mr. K**** works in a business where he is fully aware that NO LAW FIRM EMPLOYEE is personally responsible for payment to him for his service, and there is not a single law, statute, case law, or precedent where employees and legal support  staff in any law firm are personally responsible for the expenses of the clients; any judge who would hold an employee to that standard would be setting a precedent which would soon leave law firms without any support staff, causing many firms to close their doors. 

Mr. K**** was paid soon after posting this report, since he sent a copy to our firm, and I shared it with Mr. Breard - and I am left to wonder if, by this report in which he holds me responsible for an expense of the firm and client, as well as the length of time he has left this post online for public viewing, if he has done so with malicious intent toward me, after more than a year.

I was contacted by Breard Law firm's client last week advising me that this is the first time he had seen an invoice and I should have billed them instead of Breard Law Firm.  I advised him Breard Law firm hired me and that is who should be responsible for the bill I sent to them.
