On Saturday August 10th I purchased a 2020 Kawasaki KX100 Dirt Bike Price for the item $4,349 plus the shipping and extra charges total amount paid $6,395.54 with a credit card the dirt bike was delivered the same day at almost closing time the guy dropped off the bike at my address and left.

We tried to start the bike and wouldn't start I immediately, called the store and they said they were closing and would pick up the bike the next business day which would be on Monday August 12th as they would be closed on Sunday.

Monday morning August 12th a guy came to pick up the dirt bike he tried to start it but could not we met with him at Broward Motor Sport that morning and I was asked to sign a paper stating $80.00 an hour to service the dirt bike in which I refused to sign and Got a receipt for the Dirt Bike.

I immediately asked for a manager and told him I no longer wanted the defective Dirt Bike, his answer was we don't accept returns and I told him I would claim a dispute and all I heard was laughter. Him and the rest of the sales reps laughing at me and my wife.

I have never been so embarrassed in my life. The Dirt Bike was in my possession from Saturday afternoon August 10th until Monday morning August 12th 2 days. I no longer want the defective Dirt Bike and want a complete refund of $6,395.54 credited back to my credit card.

The Dirt Bike has been back in their possession since they picked it up on Monday August 12th to date and awaiting dispute resolution and BBB help

The seller and your credit card company have attempted to accommodate you; however, you are an inflexible and uncooperative customer suffering from a case of buyer’s remorse. Credit card issuers deal with complaints due to buyer’s remorse on a daily basis so you really aren’t fooling anyone.

The seller is under no obligation to store your property indefinitely and may chose to exercise their right to take possession of the bike due to abandonment.

My credit card company capital one has asked me to perform an impossesible feat to pickup the 2020 brand new $639554 defective dirt bike that's been fixed and get a second opinion at another mechanic to inspect the bike to see what is wrong with it and why it does not start they have gave me no choice but to have the bike delivered to my home.

They have rebilled my account and said they cannot  back me up unless I get this second opinion on a defective bike that has been in broward motorspots possession for 4 months. I have complied with all that was asked of me I have closed my capitol one acccount as I dont need a credit card company that doesn't help with a legitimate dispute and doesn't back up a card member with a $20,000.00 credit limit.

I am done with capitol one and been a member for 18 years I only hope that others learn something from my no good experience with these ripoff artist's at broward motorsports and by all means do not apply for capitol one credit card they will not be of any help in disputes.

Mr. ******* came into the store, selected the vehicle and was presented with a purchase proposal. Upon agreement to that proposal, he then sat in the business office, with one of our business managers, and signed all of the paperwork presented.

The paperwork was explained in detail, with the no return/no refund policy being an integral part of the process. The vehicle was prepped for delivery, where a certified mechanic checks the vehicle, and performs any needed finalization of the build, such as adding fuel, as we can't have vehicles on the sales floor full of fuel.

At that point, the vehicle is started, and all systems verified for correct operation. The vehicle was delivered to Mr.********* home, where he signed both the delivery receipt form and a VIN verification form verifying that the delivered vehicles VIN matched the VIN on the paperwork.

Later in the day, after our delivery driver left, Mr. ******* called the dealership an indicated that the vehicle would not start. He was transferred to our service manager, who explained the most likely cause as being a flooded carburetor.

Since it was late in the day, we were not able to schedule a pickup of the vehicle at that time. We sent a truck out to pick up the vehicle the next business morning. Upon arriving back at the dealership, our service manager boarded the truck, got on the vehicle and after a few kicks, the vehicle started with no issues.

The salesperson involved captured this on video, which we can provide if requested. Mr. ******* returned to the dealership after being advised that there was nothing wrong with the bike, demanding to return it and be refunded the purchase amount.

We again explained the no return/no refund policy. He indicated to our salesperson that he 'did not want the bike at all' He left the dealership, leaving the vehicle, in essence, abandoning it. Mr. ******* subsequently initiated a dispute with the Credit Card Company that was used to purchase the vehicle.

After we provided the company with all of the written documentation and visual evidence, the CC provider dismissed the dispute and released all of the funds being held during the dispute. Now Mr. *******, after losing the dispute because of its invalidity, is attempting to coerce us into some sort of refund or recompense by using third party entities, and threatening "going to the news" and/or filing suit in small claims court.

This of course, is his prerogative. We stand firm in our knowledge of the events as they transpired, as well as having all of the signed, legally binding contracts that were executed during the purchase. The vehicle has now been here more than 90 days.

Our store and company policy is that all sales are final on vehicle purchases. There are no refunds, no returns. All customers are explained this and acknowledge this policy during the contract signing portion of the purchase.

A specific form is used, and explained indicating such. We would encourage Mr. ******* to return to the dealership and retrieve his motorcycle. It has been subject to a daily storage fee since being here. As a courtesy, we will waive any storage fees if Mr. ******* retrieves his vehicle ASAP.

There is nothing wrong with the motorcycle. It has been checked, rechecked, triple, quadruple and quintuple checked. Our service manager and 3 separate technicians have inspected the motorcycle and have verified that it is in, and has been in perfect running condition.

The original complaint of the motorcycle not running can be attributed 100% to operator error. The motorcycle has already been registered and titled to Mr. ******* as of 8/12/2019. We are strenuously requesting that Mr. ******* retrieve his motorcycle ASAP.

His claim in respect to a full refund is mis-informed. Our return policy is for parts and accessories, not vehicles. This entire incident is completely and fully a case of buyers remorse. Again, we repeat that there is nothing wrong with the motorcycle.

Additionally, as stated, it has already been titled and registered in the customers name, making it a pre-owned vehicle at this point.

Please explain why a 2020 bike isn’t covered under warranty.

Shipping and extra charges of $2000 seems a bit excessive. What’s that about?

The BBB has no authority so what do you expect from them?
