Blaine Nicastro, owner of BTN automotive performed routine work on my vehicle about 8 months ago. The car was ready late in the evening, so he tried to deliver it to me at home, I was not there, so he drove the vehicle back to his shop.

While in his custody, the car was broken into and vandalized, resulting in a destroyed steering column, destroyed ignition and some wiring issues. After speaking with Blaine Nicastro, owner of BTN automotive, he had told me that he was not insured, and that insurance would normally cover something like this.

I spoke with my Attorney and he stated that we could take him to court, and that the city would possibly revoke his business license if did. Blaine Nicastro was an old friend of mine, and had a family, so I didnt want to do that to him. I told him my situation, and why I wasnt taking him to court, and even offered to pay for the parts he used to fix the damage done. He agreed, and that was that.

Since he was an old friend, I trusted him.. big mistake.
I wrote him a blank check and asked him to hold it for a couple of weeks until payday, then I would tell him what I could pay, he could enter the amount on the check and cash it.

Well he without asking me cashed the check, after entering $500 as the amount, not $150 as discussed. After calling him I was told that I could not have a refund of the excess cash, I was simply 86'd and right before I was hung up on, he quoted "take me to court f**ker"

I can't afford to take him to court, but I can afford you guys.Can you help?

On Jan 26th 2002 Sid did bring his 89 firebird in to the shop. He brought the car in for emissions Failure and a estimate on what it would cost to repair his steering colum that had been damaged from someone trying to steal the car in Dec 2001.

On the 26th of Jan Sid autherized the emission repair only and that is what we did, this bill totaling $508.91. Sid was contacted on his Cell phone and told that the car was done and he could pick up that night, He told me that he would pick up the car around 8:00pm, because the car des not lock on the passenger side and he did not want the car on the street all night.

We never heard from the customer and he never picked up the car that night. The next day when he came to pick up the car, we informed him the somebody attempted to steal the car, and now repair was nessecary, to prevent more damage and or theft of the car.

We did make an agreement that we would only charge for parts and no LABOR, and that is exactly what the bill states. But we never agreed to $150 dollars in parts Parts total 451.92.
When the car was pick up we were asked to hold the check for 2 weeks, and then it would be good, I waited from 2-15-02 to 8-02 to cash the check in the amount of 451.92.

We did speak with sid after the fact and just explained that the repairs were done at a parts only rates, the car was really damaged at his house months before this and that we felt we had done what was right.
