3/02/12  Contacted our insurance agent to inquire about our insurance coverage. We were advised that our insurance covered a truck up to 10,000 lbs.

03/10/12 Picked up truck in Austin.  Asked the agent #DELPB how much the truck weighed.  He advised us that the truck was LESS than 10,000 lbs. This statement was witnessed by our daughter, Jette. The place was very difficult to find and consisted of a small desk inside a store.  No signs with any type of information. I took his word on the weight of the truck and therefore, did not buy the Budget waiver.  We were in pouring rain and windstorm.  There was no inspection
of the vehicle at that time because of the weather. When I started driving I noticed that the brake pedal did not have a pad but was eager to get out of the storm and did not return to the agency.

03/10/12 evening: Pulling into a driveway in Ft. Worth, TX my right foot slipped off the bare brake pedal and the truck ran into a house.  I contacted Budget and our insurance company at once.  Budget sent out a representative
who took pictures and said the truck was drivable. Our homeowners insurance paid for the damage to the house. Our auto insurance investigated the accident and was advised by Budget that the truck was closer to 12,000 lbs.  Our insurance agent tried to help us on this but our policy only covered 10,000 lb. truck.

03/28/2012: Received a demand letter from Budget for claim #12T001919 in the amount of $3,978.97.  Damage Repair bill of $3468.97 PLUS admistrative cost and loss of use of vehicle.  We are protesting the claim as we were given
incorrect information by their agent.  Our confirmation and contract did not state the weight of the truck.  There was no written information on truck weights at the Budget desk.  Nothing other than the word of the agent was available. I would never have left with the truck without insurance.  The agent informed us the truck was LESS THAN 10,000 lbs.  Also, the accident was caused by a bare brake pedal.
