On Tuesday, March 10, 2015 approximately around 1:30 PM, I had a slip and fall at the Burger King Restaurant, store # 2486. Address: 7300 S. Cockrell Hill Road Dallas Texas 75236 (972) 296-0065. Upon entering in, I notice a very heavy like thick smoke and extremely strong charcoal grill odor in the air. Like someone had burned something. I notice an employee wiping/cleaning the drive thru window. It’s like she was trying to remove the grease… I also notice that there were two other female employees in the lobby, one was wiping off the dining tables and the other was moping around the entrance/exit doors area as I was entering. While inside of Burger King. I placed my order. There wasn't much lobby business but it seemed like I had to wait quite a while on receiving my order because the drive thru was keeping some of the other employee's extremely busy. Upon receiving my order, I turn around, as I am walking to exit the store, approaching the condiments area; I slipped and fell backwards and my head and upper extremities hit and slam onto the hard surface floor. As I was falling, I tried to catch myself with my right hand by reaching trying to catch my fall by grabbing the condiments table, but instead, I missed.
It all happen so fast, but inspecting the area where I fell, the floor felt like it has an incorrect application of certain oil-based cleaning product or it is just was very wet and greasy. Because as I was trying to get up from off the hard floor, I could still feel my tennis shoes sliding on the grease as I tried to catch my breath. Who witnessed; The store manager, she came and asked me if I was OK, my response to her was yes. There was the service tech guy there; I believe that he’d had just serviced the ice machine equipment and was having a conversation with the manager on duty at the front counter about the repairs and replacement parts, and he was also getting her signature upon his invoice. There was a mother and daughter that were also waiting on their order also. The mother and the store manager assist me with getting up from off the floor. The mother also help gather my sauces for my nuggets form off the floor that sprung out from my food order bag. My daughter had entered into the store as I slip and hit the floor; she found it so hilarious to see me fall. Also, and I believe that the other two female employees that were in the lobby working, witness my fall.
As I got into my vehicle, my body started to shake and I begin to experience pain all over my body… My neighbor, who lives across the street, was also with us. As I am driving towards home, the pain in my neck and shoulder had gotten worse. I pulled the vehicle over and ask my neighbor if he could just drive us home… This is when I decided that I must give Burger King a call, I new right away that I needed to speak with the store manager to inform her of my condition.
I want to also let everyone know; Prior to this slip & fall, I was injured on May 21, 2013; I was working and fell off a ladder. I sustained injuries to the right wrist, hand, elbow, and shoulder.
1. Failing to properly inspect the area, failing to warn danger, and failing to have a wet floor sign present.
2. My carelessness did not contribute to the accident. If I notice the dangerous area, I would have avoided it, or walked carefully enough not to slip or trip.
3. There were no current warnings that the area might be dangerous. I wasn’t doing anything that distracted me from paying attention to where I was going, or running, jumping, or fooling around in a way that made falling more likely.
Prior to this slip & fall, I was injured on May 21, 2013; I was working and fell off a ladder. I sustained injuries to the right wrist, hand, elbow, and shoulder.
My injuries;
As I was fallen, the back of my head slammed onto the hard surface floor. Because the force of the impact, this also caused me to re-injured a partial-thickness, under-surface tear of the foot print of the supraspinatus tendon, as well as arthritic changes of the acromioclavicular joint. My right rotator cuff tear (727.61), Right shoulder impingement (726.2). I tried to catch myself with my right hand by reaching and grabbing the condiments table as I was falling. This has caused me to re-injured my right wrist avulsion fracture-triquetrum (814.03) along with DeQuervain’s disease (727.01).
When I got home, I had a throbbing headache, stiff neck, I felt sharp muscle pains in my back and shoulder areas, my right hand and wrist has swollen, and have pain going up and down my forearm and ring finger. I went to the emergency room in Cedar HillTX at First Choice. I took 3 X-Rays, one for my neck, shoulder, and hand. The doctor diagnosed a cervical strain and a muscle tear in my shoulder and a sprain in my wrist.
As a result of my severe injuries I had to wear an arm sling. I was also prescribed pain relief medication for my severe pain. During the next 2 weeks I was in severe pain. I was unable to sleep at nights due to the soreness in my neck and sharp pain in my right shoulder. I was unable to go back to work as a Facilities Manager for 5 days. Repeat doctor visit, I was able to return to work the following week with following restrictions; Light duty, no lifting, pulling, or use of right hand. However my neck and shoulder still felt severely sore. To relieve the pain, my doctor recommended I meet with a physical therapist three times a week.
I am a Facilities Operations Manager for 17 years at Private PK thru 12 College Prep School. My job duties consist of standing, sitting, walking, bending, crawling, squatting, twisting, pushing, pulling, kneeling, lifting, and claiming.
I would like to be compensated for my pain and suffering along with the disruptions in my personal and work life, taking medications, my physical discomfort and emotional pain, lost wages, out of pocket expenses, medical bills.
