We performed an emergency cleanupof a tree that had fallen in the roadway. The tree had come from Buzzberry n Bistro's property during a horrific storm.

In our original contract with them, the quoted fee for such an action was at the rate of $250.00 per hour for afterhours, emergency clean-up of fallen tree(s) during a storm.

Here is a breakdown and timeline for the occurrence:

===================================================

Saturday, June 27, 2015       6:49p.m.  to   10:30 p.m.

  6:49 p.m.: …I received a call that there was a large tree branch that blew down from the wind storm, blocking 1 and ½ of the northbound traffic lanes of Granite Reef Rd. I immediately stopped what I was doing on another project and headed to the Bistro.

7:45 p.m.:     I arrived on site, met with Scottsdale P.D., the officer was sitting in his patrol car in the roadway, blocking anyone from running into the obstruction. As I approached his car, he stepped out and said he was glad I was able to make it, that they were trying to get ahold of someone. At that point, I assumed he was referring to the Bistro. He then stated he had to run to an emergency that a traffic light was out.

7:55 p.m.  : I was ableascertain that there were no injuries. I was also informed that 4 individuals had already unsuccessfully attempted to lift and remove the tree from the roadway (I tried to lift one end by myself….impossible).

 I then began positioning my truck and trailer as to impede traffic in a safe manner, with my flashers going, we then unloaded cones and barricades from my truck and placed them per Traffic Safety Standards and M.A.G. Standard Details.

Once we had traffic diverted and the lane secure, I asked if anyone had contacted you regarding the situation. I was told no.

8:33p.m.:  I texted you asking you the same question.  I waited for a response from you before proceeding with any more work other than the traffic/life safety functions, which we had already performed.

8:51 p.m.  At the same time I was receiving your text response, Curtis came out with the restaurant’s portable phone stating “you were on the line and you weren’t happy”. Through some confusion, we were able to reconnect a dropped call. At which time you stated “you had not been informed of the situation” and you and I then came to the agreement as stated above the timeline.

9:03 p.m. We began the extraction process by cutting the tree with a chainsaw, when the chainsaw stopped working due to a fuel supply issue, I ran to Walmart to buy the replacement part necessary to run the chain saw. I also bought a new back-up chainsaw, so as to avoid any other equipment issues. I returned to the Bistro and we resumed the extraction process

9:10 – 9:30 p.m.  Trip to Walmart for parts.

9:30 p.m.  Resumed the extraction process.

10:11 p.m.  We cleared the last of the tree from the roadway and began clean-up efforts of the debris left in the roadway.

10:25 p.m.  All debris is removed from roadway.

10:30 p.m. We completed the task of removing the cones and barricades from the Granite Reef Road, thus opening up the prior blocked traffic lanes, to allow for safe travel.

 We are happy to report …. No accidents; No injuries.

===========================================================

Webb Worldwide L.L.C. was “on call-out” for this emergency from 6:49 P.M. until 10:30 p.m., the night of 06/27/2015.

Personnel on site: 1 foreman and 1 laborer

  • Billable Hours: 3 hours and 41 minutes(3 & 2/3 hours) @ $250.00 per hour (see original proposal), for a total of $915.00

  • NOTE: In light of the fact that Buzz Berry Bistro also took care of the feeding of the crew after task completion and other deciding factors, Webb Worldwide is only billing Buzz Berry Bistro at $200 per hour for a total of $732.00
  • For an additional $65.00 to help off-set the cost of fuel and dump fees, W. W.  L.L.C. will haul off the discarded tree branches and associated debris, no additional fee for labor.

  • That would make the total billable of $797.00

  • We can schedule the rest of the removal for Tuesday 06/30/2015

=================================================

 We tried for weeks and weeks to get paid.....

They wrote us a check for $125.00 and then stopped payment on the check...

That same day they made a Paypal Payment for $125.00 on 08/05/2015

To date they have only paid us  $125.00 of the  $732.00 that was originally billed

(including the discount given, assuming they were going to pay and remain our valued client)

Now we also have several hours racked up in trying to get paid .... letters &  invoices had to be written, trips to the bank, etc.

We drastically reduced their invoice .....

To the totalof  $250.00 if they would pay it and end the nonsense....

They won't even pay the remaining balance of $125.00.

Gave them until 8/20/2015 to pay it  (balance of $125.00) or the original total amount  of $915.00 (removing discount ) would be turned over to collections.

Don't do any work for these people .... they won't pay you....

THEY WILL ONLY RIP YOU OFF !!!!!!
