One year ago we had the misfortune of setting foot on the car lot from hell. Because of economic times we were reduced to doing business with these types of criminals. We neede a vehicle to get back and forth to work. The salesman said the more you put down the better vehicle you get. We only had $500 to put down so that severely limited our choice as to what cars we could pick from. Our choices were one of two cars and unfortunately we chose the wrong one (could there have been a right choice?)

The next day we had the car back to them because of a loud thumping noise when whenever we hit a bump in the road. They said it was the driver's side wheel bearing. Then they said it was a motor mount. They said they replaced it but we still had the same problem. I told the salesperson that we wanted to put our own plates on it because we had vanity plates. He said that was fine and then a couple weeks later we got plates in the mail and the price was over $100. I called them and said we told them we wanted our own plates on and they said they didn't have a record of that so we had to keep the plates they "bought" for us. They were going to come and repossess the car if I didn't give them the money for the plates plus the payment for that week. All of the finance people are the rudest people I have ever dealt with and they just don't care.

We bought a convertible in which we could get the top down but couldn't get the top up withouth physically lifting it up. The car roof leaked and after we had a huge rainstorm the car started to smell like puke. On my way to work after the storm I heard sloshing in the trunk and it was full of water. My husband had to drill holes in the bottom of the trunk to get the water out.

After we tried drying the carpeting in the front on the passenger side, the smell got so bad, my husband had to cut the carpet out. On my way to work one day, during rush hour, the car stopped running all together and started smoking. I had to have someone push me to the side of the road to get out of the way of traffic. At that same time I had a wrecker come to tow the car back to the Cactus Jack lot on Camelback Road. They claimed they repossessed the car when in fact we gave it back to them. After a couple of weeks they called and said where is the payment? I said we weren't going to pay for it because they had the car back. They didn't even know the car was returned to them. They didn't offer to fix it or even look at it. Eventually they sold it for $274 (which right there tells you what it was worth) and I said I wasn't going to pay for something that wasn't worth the price in the first place.

They pray on hardworking people who try to get through the hard economic times and they don't care what they do to their customers when they are trying to get their money. We just got served with papers stating they will garnish our wages to recoup their money if we don't make payment arrangements with them immediately.

DON'T BUY FROM THESE PEOPLE!!!!

So the economy hit you hard and were forced to go to this dealer.  Yet you had vanity plates that you wanted to use?  On top of that you select a convertible?  Seems like your "taste" may not be quite in line with your current "economic situation", and may be part of the reason why you ended up at this dealer.

It does not matter if they come and get the car or you return it to the dealer.  It is still a reposession.  As such they will sell the vehicle at auction and you are still responsible for the balance of the loan.  It is standard for a vehicle to be sold for a fraction of it's "value" at auction.  In your case drilling holes in the trunk was a bit excessive and probably was a big reason that it only sold for $274.

Now, as for the Wage Garnishment.  In order to garnish your wages they first must file a suit and get a judgement against you.  So if the papers you were served with was about a suit you need to do follow the instructions on the papers to make sure you don't get a default judgment against you.  If that means you need to file an answer..then file it by the deadline.  If there is a court date DO NOT just ignore it..you MUST go to court.  Not that you are going to automatically prevail, but you can at least give your side.
