I need help! I just read all these ripoff reports, unfortunately I didn't try earlier. I am a single mother, low income due to an accident over a year ago, still not working full time, am about to go into surgery again for the same injury and will not bw receiving a salary...CAMCO contacted me a few months ago and I did ignore them for awhile.

However, they continually threatened me with action and explained to me that even though the statute of limitations had expired (debt is approx. 10 yrs old) they can still come after me for the original debt plus interest and late charges to date!

I think I made a stupid mistake, I sent them three payments of $15 each and have now given them post-dated checks to equal $400, $100 per month thru June. Have I reinstated the statute of limitations and therefore made this debt valid again? OR should I stop payment on those checks before they are able to cash them and am I within my rights to do so???

If you have not contacted the Fair Trade Commission do so immediately that number is 1-877-382-4357 and file a complaint. The more complaints they receive the more likely they are to do something.

Contact the Illinois Attorney Generals Office Consumer Protection Division 100 W Randolph 12th Floor Chicago, IL 60601. (312) 814-3000. This company is NOT a licensed Collection Agency so when you have to make sure that you tell them you want a complaint form mailed from the Consumer Protection Division. The Department of Professional Relations has NO Jurisdiction over them.

Contact your local Attorney General Department of Consumer Protection. Some states have laws against this type of collection attempts.

Stop payment on any checks. Do not send these people any more money. As another suggested, change your checking account. This is probably necessary, as this company may try to freeze your account (not sure if they can, but they are not known to be entirely ethical in their methods).

Finally, Contact all three credit reporting agencies (Transunion, Equifax, Experian) and place a dispute in your credit report in the event this company attempts to place this on your credit report.

Stop payment on those checks NOW. Tell the bank you have been ripped off and to block anything that comes from this company. If you can change your checking account number. Writing those checks did not restart the SOL. Unless you signed a document from them stating you were acknowledging this debt it did NOT restart the statute of limitations. Here is the New York code.

17-101. Acknowledgment or new promise must be in writing. An acknowledgment or promise contained in a writing signed by the party to be charged thereby is the only competent evidence of a new or continuing contract whereby to take an action out of the operation of the provisions of limitations of time for commencing actions under the civil practice law and rules other than an action for the recovery of real property. This section does not alter the effect of a payment of principal or interest.

Hi,

I wish that you had contacted Rip-Off Report before you sent any money! Any debt that is as old as the one you had has been charged off or sold and cannot be collected by the collection agency unless you acknowlege the debt; which you did by paying the $15.00 payments.

You had the right to challenge the full amount of the debt that they said you owe. I would contact my attorney generals' office and see what he reccomends or get the advice of an attorney that allows the first visit to be free.

I don't know what they say you owe but if it is a good amount it may be worth it to seek some legal advise instead of giving them money you don't have. Another downside of what you have done, is given them leverage to show this on your credit report again for another seven years.

Stop payment on your check and tell them not to call you and if they do you can file charges with your attorney general. Tell them you are seeking legal advise and your lawyer will be in contact with them soon.
