Capital First ripoff consumer fraud screwed others too Miami Florida

I too was ripped off by this company. They promised a zero percent, $5000.00 limit mastercard. Like most of you I never recieved my packet and had to request another one be sent. I, like you, wasn't told that it was a pay-as-you-go or a stored value mastercard and I was led to believe that the fees would be put on the card. It wasn't until I had seven checks bounce and five days of contunious overdraft fees that I found that Capital First had withdrawn $99.95 and $59.95 from by checking account. These were unauthorized withdrawals first of all, and since I never was sent my first package I didn't know my 7 day trial period was up. After filing a report on this site I made an appointment with an attorney and this is what she told me:

1: File a report with your local police department. They might not be able to recover your money, but you'll have a report on record. Some cities now have a fraud department.

2: File a report with the FBI. I filed my report right from her office over the phone. One report won't do anything but get Capital First into their data banks, but lots of reports will get an investigation started. This fraud company needs to be shut down!

3: Send a complaint to the real Mastercard. Their web address is customerservice@Mastercard.com. I sent them an e-mail about this company and guess what? Mastercard stated that Capital First is not an affilliate or a card issuer and their fraud team would be investigating.

4: Confirm your cancellation with Cap. First in writing. Send it PRIORITY MAIL with an ID. sticker on it. This way you can make sure that it was recieved by Cap. First and the Post Office has record of it that it was recieved. Fedreally documented evidence is hard to dispute. There is a number on the sticker so you or the post office can track it down

5. Inform your bank in writing what has happened and that the funds that were withdrawn were not authorized by you. Print up a few reports from this site to back up your story. Send your letter by certified mail, then, go down to your bank when you know that they have recieved it. File an affidavit stating that you did not authorize these withdrawals, this could help you get your money back with the help of your bank. My bank did this for me, although it has been too soon to see a refund yet. My bank also went through my statement and determined that none of my checks would have bounced if Cap. First would not have withdrawn money from my account and will be reversing the charges.

6: Write a complaint to your states Attorney General. They will have a web address and you can print a complaint form off the internet. Send your complaint to the A.G.'s office by certified mail or priority mail. The A.G.'s office may be able to help you get back your money also.

7: File a complaint with the Southeast Florida's Better Business Bureau. Send a certified letter.

You can also go to small claims court and probably win. Take copies of everything with you to substantiate your claim. Keep copies of all your reports, letters and reciepts. The attorney that I went to specializes in consumer law and knows her stuff. If you need the help of an attorney, I would suggest one who specializes in consumer law. Good luck every one.
