Some good news. This week I got my money back and my overdraft fees reversed. This is what I did.

1) You go to your bank and make them aware of the problem
(printing out a page of headers should be a starter).
You should also file a compliant whith the Federal Trade Commission and the Florida Attorney General's Office (if you go to the web site for the state goverment of Flordia you will find both forms there, you need to prove to the bank that you tried to get you money back and are being stonewalled.

2) Tell your bank rep that you want to dispute the charges (there is a form that the federal reserve requires to reverse funds that are in dispute.

3) It took only 3 days to get my money back (the funds are acualy reversed when Capital First doesn't fight to retain the money).

4) Ask your bank to refund the overdraft fee my bank did and suggested that I close my account which I'am doing.

You only have 30 (with some banks 60) days from the date your account was debited to fill dispute. Do not waste your time with trying to call again and again Capital First.
