It started when I lost one of my jobs and got a cut-back on my part-time job. I consistently send as much as I can to make my monthly payment.

When I purchased my car it was near the 1st of the month. I asked CapOne to change the due date to the end of the month. Instead of moving it backward 5 days, they moved it forward 10. Therefore, guaranteeing me that I would not be able to make the payments ontime.

Since then, beginning on the day that I am 1 day late sending in a payment I receive at least 5 phone calls per day until I answer the phone. Well, it doesn't stop there.

I also have been a victim of the "holding of the EFT draft" problem. I too have a Bank of America account and authorized an EFT payment. Usually this transaction will take place in a matter of 24-48 hours. It's been two weeks now and the $$ still hasn't cleared my account. And yes, I STILL RECEIVE 5 CALLS A DAY FROM CAPONE.

There is a catch with CapOne. All other finance companies will allow you to refinance a loan. Well THEY DON'T (WON'T) DO IT.

There has got to be a way to stop CapOne's unscrupulous way of handling their clients.

I am not a customer of Capital One, have never been a customer of Capitol One but TOTALLY understand their harassment b/c they keep calling me looking for a woman named Jennifer Lutz. Not me, don't know who she is but their customer service people are completely obnoxious and refuse to stop calling. Below is a copy of my own complaint. I hope that you get relief from this b/c I certainly understand how annoying it is.

And one last thing...why should I have to change my phone number b/c of their total inability to be reasonable?

"I have been getting phone calls from Capital One for some girl named Jennifer Lutz. I do not know who this woman is nor do I care. I have been getting collection calls from Capital One for months now and they refuse to believe that I am not this person.

I have told them they have the wrong number and they actually argue with me. The have been horribly rude to me and never stop calling. I am at the end of my rope with this. I get calls all day and up until 9pm in the evening and I have small children.

I have good credit and have never had an account with these people in my life but I pay the price for some woman who gives out a false number and doesn't pay her bills. Its not right and I want it to stop. How can I get them to stop calling me?"

love the blank check product. Have NEVER once heard from them. Pay my bill through my bank's online bill pay, EVERY MONTH ON TIME. I have to, why should the OP get special treatment?

I love these posts by people in complete denial and with no personal responsibility who blame everyone but themselves. This is not a ripoff.

Pay the bill on time. I have COAF also, did not receive a bill one month due to a mail truck accident. Got the calls, paid the bill. No more hassle. They are very persistent, that's what they are paid to do. What the whole thing comes to, pay the bill.

AND PLEASE DONT TELL ME THAT THEY DONT BECAUSE I HAVE PROOF THAT THEY DO.I BOUGHT A CALL ID SYSTEM FOR MY PHONE THAT KEEPS AN INTERNAL LOG OF ALL INCOMING CALLS AND I CAN DOWNLOAD LOAD IT FROM MY COMPUTER TO SHOW EXACTLY WHAT DAY AND WHAT TIME THEY CALLED. I REPEATEDLY ASKED THEM TO STOP CALLING SO MUCH AND THEY TOLD ME NO. I THEN FILED A COMPLIANT WITH THE BBB AND PROVIDED THE PROOF. BECAUSE I DID THAT I GOT A LETTER FROM CAP ONE STATING THAT THEY WOULD NO LONGER CALL ME. I'm a bit confused about the rip-off here. What is it? You're not paying on time. Capital One was courteous enough to allow you to move you due date because you couldn't fulfill your original payment date which you are given a choice on when you sign the contract. If you were paying at the end of the month and COAF moved you're date forward then you should have extra time to get your money in. Send the money on the same date. You don't have to send it exactly on the due date. It can come early you know. So the due date situation was really not an issue. OK, no rip-off there. Let's see. Oh the phone calls. We all know it is not illegal to collect on money owed. COAF can call 800 times a day if the company feels like it. As long as you pick up and speak to someone then the calls stop for that day. OK, again no rip-off.

Next, the refi. Please don't say that all other companies refinance their own loans because I can guarantee that is not true. Why would they? Still no rip-off. I think the case here is that you bought a vehicle you clearly can't afford, obviously have issue budgeting your money(since you can't hold the money in your account for a week longer), and excuse me for saying, but you have trouble excepting blame. If you had a valid situation I might feel different, unfortunately you do not. Just pay on time. If you can't, then accept that you'll get calls, extra interest and possibly repo. Again accept, NOT BLAME it on someone.

ok, the due date.

your loan was at the 1st of the month and you wanted to pay at the end of the month. ok, and the difference is .?

I mean regardless what time of the month is your payment due if you are organized enough you can just leave that money aside and pay on time.

Are you telling the truth? with all due respect, that auto loan company dont call people 1 day behind, there is a grace period for the nice people that pay on time and send a mail in payment every month. and yes, things happen, the mail man might stop and get some coffee or the weather is not the best so the mail might be delayed. that period is 10 days. so are you 1 day behind or 11??? isnt the 11 days enough to get your paycheck if thats the issue?

the monthly payment has to be on your budget and regardless if its the 5th or the 17th you have to count on that money TO MAKE YOUR CAR PAYMENT. now, if you are the type that cant resist some money on the bank, or you are not organized enough to put the money aside. then its your issue.


at the beggining of your report you said "I consistently send as much as I can to make my monthly payment."

your monthly payment is not as much as you can send, it is x amount that you agree to pay monthly. so consistently sending as much as you could, doesnt mean you where making your monthly payment.

And guess what the catch is for not refinancing your loan?

let me explain it to you on a way you might understand.

if you let me borrow 20 dollars and i cant pay you. (with excuses like: jo, you are not asking me for the money on the right day because i got paid 5 days ago) will you loan me other 20 so i can pay you back?

why will a finance company pay its own debt with a loan that will probably not get paid?

and yes There has got to be a way to stop CapOne's unscrupulous way of handling their clients.

by paying the bill on time and not being a collections "client" on the first place.

you stop being a "client" and capone stop irritating you by asking for their money back.

The phone calls are easy to stop. Change your phone# to an unlisted one!

As far as the due date goes, you knew what it was BEFORE you signed the finance contract if you were paying attention.

If you knew the date would not work for you, WHY did you take the loan?

They are a business, and are in business to make money. That is the whole idea. They are not the welfare office and really don't care if you lost your job or anything else. A contract is a contract. You knew the terms.

My advice: Let them have it and go to a buy here - pay here lot with a weekly payment. Try trading it in if your feeling lucky that a dealer will take it "upside down" on the loan.

It's all about CHOICES we make.

Capital One Auto Finance does not refi their own active loans and contrary to what the original writer listed - most auto companies don't refi their own loans.

What you can do is apply to a company that does refinance auto loans & if you qualify you can use the approval towards your current loan. Still a refi is a NEW loan. As for the Due Date change, moves must be a minimum of 7 days to the future, they are not mandatory for any company it is by choice of the company.

Capital One Auto Finance, COAF lets you move the DDC 15 days to the future but not during the last week of each month. We never move a DDC to the past. Your contract states that when your 1 day past due your late. We don't even start calling until your 10 days past due.

Lastly, EFT's are done on the day listed. If you have one with COAF & it has not cleared your bank then it's your bank not listing it. If it's marked in our system we have already sent it to your bank. This person either is not paying attention to their contract, or just wants to complain. The argument listed is incomplete from their side.
