Complaint Review: Capital One Auto Finance

Capital One Auto Finance Approved for car loan verified by a dealer then 2 weeks later check bounced. Dealership has suite againist Captial One Auto Dallas Texas

In October, 2007 my husband and I were approved and sent a blank check. We traded our old vehicle in and bought a new car. While at the dealership the finance officer called Capital One Auto (just as instructed on the check to do) The Finance Officer was given approval by Capital One Auto. She then sent all information to them by fax. Everything was still approved. Two weeks later, they sent check back and said we were not approved.
By then the new car had been titled and reg. in our name.

The dealership now has a suite againist them, we have no contact although we have been told by the dealership that we do have a contact with capital one. The dealership insist we make our payments to capital one not to the dealership and capital one has been taking our payment but cannot and will not give us an account number. They keep saying we do not have an account with them. OK, then where is our payments going?

Now, when I call capital one they say they cannot discuss this with my husband and me due to the law suite pending from the dealership. My question was What the #%@ does that have to do with us and where is our payments being applied if we have no loan? We did everything right, the dealership did everythind right. We have good credit and trying to do the right thing by paying for a vehicle that they say is not ours, and of course the dealership is saying it is ours. This is now going on for 3 months. Do we owe the car or not?

Michael:

I do read and keep up with this site. I would like any advice that I could get. I was told by car dealership that Capital One Auto has hired a local attr. They (Car dealership) seems to think Captial One will settle.
Which is great for them but what about us. We are still making car payments on a loan that Capital One Auto said we do not have and our payments are being cashed by them.

How about people any advice? Should we seek legal help?

I've done these from the dealership perspective before, and I have an idea what happened. But I have to be honest, I've responded on quite a few rip-off reports, and to date, not one person has listened to what I've suggested or taken any action I've reccommended.

I might be able to help here, but before I take the time to write the whole thing out, I'd like to know you're actually following your own report. If you want my advice, please respond saying you do.

I've spent entirely too much time over the past couple years trying to help people on this site only to be ignored or scorned for my suggestions. So if you're interested, let me know.
