I financed a ford f-150 through capital one auto finance. After a few months I refinanced my house and had a payoff for the truck. The payoff amount was pulled directly from my credit report by the finance company. When I offered the payoff amount the rep. La Mountain , a supervisor, told me that was not the right amount and even if I did pay that amount I was still responsible for the $450 until the end of my term almost 5 years. How is it possible that I would have to pay almost 50,000 for a three year old truck? When I talked to another rep she called me a liar and an idiot and was quite rude. I would recommend that everyone avoid this company in the future. Their customer service is horrible and they do not maintain proper records with the credit bureau.

Jeremy,
Good morning, afternoon or evening.
First off let me tell you thatI have worked in the Auto/Finance industry for about, well since I was 10 ( My father owned 3 car lots) I'm 32 now. A few points.
1: The amount listed on a credit report is 99.9 % of the time not the amount that you owe. Often times what is listed is the approved loan amount or top credit allowed. That means that if you get approved for $30,000.00 It may show that or less if it tracks the monthly payment history. It will not show the finance charges. this is why your payoff is not going to match you credit report.
2: If indeed you were refinancing your home, most banks will have to get a 10 day payoff from the lender. they do not go by the credit report. The fact that you had to pay out of pocket makes me wonder about the people your refinancing with. When someone wnats to pay off a vehicle I always advise them to find out when the check will be cut & get a pay off for that period. Normally that's a 10 day payoff.
3. This is really part of number two, but your refinance documents should show the checks that were sent out. You should have a copy of the amount & address sent. They should also be able to give you a copy of the cashed check. It's how they prove that the debt is removed from your credit report, thereby affirming your acceptable debt to income ratio.
4. Please check your auto loan documents. I haven't seen an adjustable rate auto loan or prepayment penalty since I was about 15 & my father said he would beat me if I signed a personal auto loan built that way. Check your documents. I've never seen a $17,000.00 Truck paid off at $50,000.00. The APR would have to be over triple digits or over 84 month.
%. Do not threaten with the TX AG, becasue in the end if the company can't find the payment then the AG will direct you back to your bank to do what they should have done - given you a copy of the cashed check.

Jeremy, I take it that you a very smart & a great peson. If this was sent to the right place I can say the check may have been cashed but is sitting is a holding file due to some missing information. I would also submit that the cashier check is being held due to your claims of a payoff. You have 3 different departments doing nothing to help you. Call the corporate office in TX, not florida & not Oklahoma & not california. You need the one in Texas. tell them you need the payoff department. No Collections, No titles, No Defiency department - JUST PAYOFF. Have them research the mail from the days your check was cashed. Then have them check the mail from the dropboxes. thats what the PO Box addresses are. The ONLY other thing you can do alone is get the copy of the cashed checks, MO. Have the collecter check the Lost log. this is a log of all payments received that have not been posted to an account. This is found in accounts receiveable. They hold all of this on an excel database. If this doesn't work you'll have to get an attorney who will do all I have listed. I hope this will help you get it done without an attorney costing you more. Keep in mind not everybody who works in the field agrees with the large wholes in the process.

Keep contacting the bank until you get an answer the absolute proof you need

If Capital One rep calls again, ask to speak to supervisor. If he acts like an a*s and doesn't do it, threaten them that you will contact the Texas Attorney General and file charges against them because (hopefully by this time) you have proof that they received it.

Capital One Has Lost MY Payoff on my Truck

#12Author of original report

Mon, March 10, 2008

After sending these 'people' a payoff (the amount which was posted on my credit report, please read original story) I went ahead and paid what they said was remaining on my account, $1137 or about that. I sent a cashiers check. The cashiers check was cashed on March 4th, but Capital one is continuing to call and harrass me. One guy called saturday and told me he needed a check over the phone 'right now' and when I told him no he got aggressive. How can I stop these people? I have proof they cashed the cashiers check, but no one on the banks end will admit to anything. I even emailed their customer service department and have not heard back from them. I am afraid of having my truck Repoed. (the first lady I talked to when all this started 'LaMountain' seemed to want to come get my truck).

First check your loan agreement very thoroughly. If there is no penalty on early payment, send them a letter stating your intention and ask them for the payoff amount. If they give you some ridiculous amount (since you are in Houston) contact Bud Hibbs at budhibbs.com. He is a consumer advocate attorney and would know how to deal with Crapital One.

Good luck!

loan documents very carefully.

I have had plenty of auto loans but I have never had an auto loan that had an early payoff "penalty" but I've seen reports of this.

Check your loan contract - read every word. There should be a section or paragraph that addresses early payoff.
