I am filing a dispute on behalf on all three of my Capital One credit cards

I lost my job on 5/23/08 and contacted the Payment Protection Company listed on my bill to inform them of my updated status. Payment Protected immediately started their payments effective 7/18/08 for card ending 1012, 7/7/08 for card ending 6217 and 7/1/08 for card ending 0036.

I was not aware nor properly informed that Payment Protection requirements was to file a continuation form after 6 months of being unemployed. The company states that information was sent to me. However, I never got the information requesting verification of unemployment.

When I noticed that there were no payments being made to my three cards I contacted Capital One and was advised that Payment Protection would take care of any fees that they billed. This was incorrect information. Payment Protection sent me to Capital One to have fees adjusted. And Capital One sent me back to Payment Protection. This continued for months.

I have continuously called Capital One 800 number to inform them that my account is not being paid by Payment Protection and 1) because there is no payment I will have a late fee and 2) because the late fees will be added I will have over-the-limit fee. I was ensured by Capital One that would be no problem to have an account update based on documentation received from Payment Protection.

In May 2008, Payment Protection received all documents and made retroactive payments to have accounts after months of non-payments. Although, Capital One has received all information showing retroactive payments they are still refusing to waive all over-the-limit and late fees.

I am writing this letter of complaint requesting research because Capital One has not listened nor taken the time to research either accounts or representative are adamant that nothing could be done. I have been repeatedly told by Capital One we could not do anything for you" or you waited too long although I have reminded Capital One that they failed to assist me properly at the 800 #, and instead provided me with an inadequate explanation of my right to dispute.

I'm requesting ALL late fee and over limit fees on all accounts waived, reversal of any adverse report to the credit bureaus and adjustments of finance charges based on new balances. I am prepared to fight this until this case if fully satisfied. I will not take a compromise or partial credit.
